I was discriminated against by the following companies:

(1.) Schlesinger Associates,

(2.) Coleman Research Group, Inc.

(3.) KTAR newsradio at 620 a.m.

STATEMENT OF FACTS;

(a.)(Mr. Erik Hellum) GM for KTAR radio station is owned by Bonneville International located in Utah is buying a local Hip-Hop radio station (KKFR) at 93.2 FM located in Phoenix,Az.,KTAR will remove the programming of this hip hop station and replace it with a conservative news and sports channel.

(b.) KTAR radio station hires The Coleman Research Group, the New York based research company to conduct focus group researh for the KTAR radio station.

(c.) The Coleman Research Group (owned by Kevin Coleman)in turn hires Schlesinger Associates in Phoenix to do the actual work (conduct focus group projects) for KTAR radio staion.

(d.)The aim of Schlesinger Associates Focus Group Project is to collect data (opinions) from the many KTAR listeners as to what programming should be aired on KKFR that will replace the local hip-hop station.

(e.)Mr. Erik Hellum of KTAR radio has claimed his station serves a "great racial diversity" of listeners in the Arizona community.

(f.)The demographics of the listeners of KKFR radio station at 93.2 FM is hip-hop, meaning that the listeners are young whites, Latino's and African Americans.

(g.)Schlesinger's focus group project pays $80.00 for a two hour session.

STATEMENT OF THE CASE:

On July 23, 2006, an employee from Schlesinger Associates (Amber Anderson) phoned me requesting my permission for an interview for a Focus Group Project. The subject matter to be discussed was regarding "what radio/talk stations do I listen to?" I could not immediately remember so I asked my wife and she assisted meduring the interview and KTAR was mentioned. Ms. Anderson continued questioning me concerning my age, employment, salary and basic lifestyle.I asked Ms. Anderson how is this interview going, she stated the interview is going well, and then she stated,"I have just one more question to ask regarding your race?" I informed Ms Anderson that I was an African American. Ms Anderson replied that,"I did not qualify for the focus group due to the quota for african americans had already been met." Ms Anderson remembered that my wife assisted me during the interview and asked the race of my wife? I stated that my wife is Caucasian. Ms. Anderson then sked to speak with my wife and soon qualified her for the focus group that I did not qualify for. The focus group that I am referring to was held on Wednesday, August 3,2006 at 6:00p.m.

On August 3, 2006, my wife attended this focus group and was surprised when she arrived at Schlesingers to find there were no african americans present.

When the 6:00p.m. focus group had ended, my wife walked out , she was told there was another group of people waiting for the same focus group and she was not to discuss the contents of her focus group with the others waiting. When my wife walked out past the others waiting for the 8:00p.m. focus group, she noticed once again that there were no african americans waiting to attend. In her group session there were 16 people which were divided into two groups of eight. There were also 16 people waiting for the 8:00p.m. focus group session.

After my wife attended her focus group, she informed me that KTAR, a prominent radio talk show here in phoenix, had sponsored this focus groupand the questions and opinions were predicated upon KTAR purchasing a new fm radio station.

Since the above discriminatory acts of the above companies and individuals were perpetrated upon me, I have spoken to Ms.Trina Boudreau, the Facility Director for the Arizona Branch of Schlesinger Associates. Ms. Boudreau has stated that; "We did not discriminate against you however, we did not want the opinions of african americans because we are purchasing a hip-hop station that african americans are acustomed to listening to." Furthermore, she stated that: "When we do not want certain groups of people to share their opinions with us, we simply inform them that the quota has been filled."

I have also communicated with Mr. Erik Hellum of KTAR radio station, he stated in a letter dated: September 15, 2006, that; "I take full resposibility," for hiring Coleman Research Group, Inc., the New York-based research company that hired Schlesinger Associates to conduct focus group research for the Station. As promised, I did indeed, look into the situation, and I concluded that KTAR does not want Schlesinger Associates or anyone else limiting our focus group participants based on race - even though the law permitsa radio station to target a specific audience, including one based on race."

I have also attempted to contact Mr. Kevin Coleman at his New York based company (Coleman Research Group, Inc.) I recieved a letter from Mr. Kevin Coleman stating that; I have the wrong company, no one's at home, please go away."

Legal Theory:

The above companies and individuals have violated my civil and constitutional rights (First and Fourteeth Amendments to the Constitution.)I was denied and equal opportunity to participate in and express my opinion based on Race, whereas I was otherwise qualified to do.

The above companies and individuals discriminated agsinst me based on race, instead of using the demographic make-up of its listeners to deny me access to Schlesingers Associates Focus Group Project.

Conclusion:

KTAR hired Schlesinger Associates to target a specific group of people (Caucasians) and to exclude all african americans due to the color of our skin, regardless of the contents of our character. Not all african americans listen to hip-hop, just as all african americans are not democrats. African americans are a diverse group of people both economically and politically, yet I was treated differently by KTAR and Schlesinger Associatesat their Focus Group Project because of the color of my skin.

Well, Once again here we go with the same old song. Why is it that EVERYTIME an " African-American" doesn't get his/her way he/she hollers DISCRIMINATION? I don't see Latinos saying that. Or how about Middle-Eastern-Americans? Everyone commenting here has yet to address that this company is a FOCUS GROUP survey company. They select who and what questions will be asked. Who is Benjamin to say he MUST be hired or else! Being Black isn't a free ticket to anything you want! Get over yourself! I was selected for a survey about grocery shopping and when I arrived I was told there was a mistake that they wanted women only. Ohhhhh! Should I run to the nearest lawyer and file a gender discrimination suit? They have a formula ( which I can't even figure out but they can ) and they need ONLY people meeting CERTAIN criteria. They were so nice and even paid me $100 for coming out. I also observed that not everyone that participates in one particuler survey is interviewed at the same location at the same time. Did Benjamin have agents watching every Schlesinger location everyday? Did it occur to him that MAYBE "African-American" survey takers may have been interviewed on a different day? Or maybe they didn't include them and many other ethnic backgrounds, not JUST "African-Americans"? You know the saying, if you cry wolf too often, people will stop believing you. Benjamin should also consider his Libelous statements. If he can't prove his accusations ( And so far all I've seen from him is rhetoric. )

How do you know it was based on your race? In order to stop people like yourself from blowing up over not making a study and calling back and just lying and ruining research they still take you through the entire screener before "terminating" you. With the time and energy you fruitlessly rave about this you could have made more then the $75 they would have paid you for the survey.

Ben, While I do not work for Attorney Schlessinger, I DO appreciate the comment that my response was of legal standard. I am 25, just took my LSAT's and I'm looking into law schools as I type! Maybe I will make it after all... Back to the case at hand, in response to your last comments: You keep referring to laws and judgements that protect EMPLOYEES. A focus group is not employment in the labor law sense. Therefore, these laws will do not apply to you here. Here's an explanation to your question, "what happens where an African American meets all established criteria and demographic standards that were created for a conservative (white) focus research group?" If the administrators of the focus group are looking for an all-white group, and you are non-white, you DO NOT fit the criteria. It is not illegal to hold an all-white focus group. Just as it is not illegal to hold an all-male, all-female, etc. focus group. This example is parallel to your logic: I am a woman. I have come across a focus group being held for opinions on the comfort of jock straps. Is it "sexist" that in this case, my opinions on the subject of jock straps would not be as valued as a male's? No! I am NOT part of the desired demographic in this situation and therefore my opinion on how comfortable jock straps are would not be desired or valued. This is not to say ALL women do not/cannot/ have not ever worn a jock strap. However, it is UNCOMMON for a woman to wear a jock strap in (safe to say) MOST situations and therefore a woman's opinion would be rendered useless in this group. It is frustrating for me to read your comments that everyone employed at this radio station, the law firm, or anyone who disagrees with your views on this subject is "racist". You are taking time away from a system that could be hearing cases for ACTUAL racism, and correcting injustices against people who have actually BEEN wronged. If I were you, I would save my time, energy and money on pursuing this legally. My bet is on the judge dismissing this case, as it bears little, (if any) logic.

Thank You, for taking time to explain and demonstrate intelligently as to how Marketing companies do business.But, you failed to explain, "what happens where an African American meets all established criteria and demographic standards that were created for a conservative (white) focus research group?" Do you deny this African American an opportunity to participate and express his opinion in this focus group because of the color of his skin?" 'NOPE,'this is America 2007, not 1907. Mr. Demographics, you are attempting to defend Schlesingers Associates "backwoods racial mentality" by providing them with a way out. The "defense" you are providing is call Schlesinger Associates is called: "Bonafide Occupational Qualification Exception." The definition of this legal term is: "A bonified occupational qualification allowing discrimination in employment is permissable 'only' where the employer can prove a factual basis for believing that all or substantially all members of a class covered by that act would be unable to perform safely and efficiently the duties of the involved. Absent a showing, an applicant for a job in issue may be excluded only upon a demonstration of individual incapacity." Mr. Demographics, your train of thought equals that of Schlesinger Associates "backwoods." As I stated before, African Americans are in all sectors of this country, i.e. political, religious and economically speaking. We refuse to be pended down and chained according to any "1907 backwoods mentality." Once again, thank you for allowing me to set the record straight.

Ben, buddy. Focus group are setup by marketing companies. They are hired to market a certain demographic. (Take nothing I say to be racist, sexist or whateverist). If a company is selling cowboy hats, they would market white males over 50. That is their market. McDonalds does it on a regular basis. They know that their "demographic standard" is the black person from 16-35 who lives in the inner city. That is the bulk of their customers. Is everyone who walks into McDonalds 16-35, black and lives in the inner city? Nope. Their commercials also directly market folks of this demographic. This is the way that companies hit their direct customer demographic. Let me set this up for you with a few questions. If I were selling minivans and wanted input on future models would I survey: A. Over 60 hispanic males B. 16-25 year old college students C. 30 something middle class women D. Welfare recipients who receive foodstamps Easy. C is the correct answer. Next one. If I were marketing my audience reactions to programing on BET, would I survey: A. 30-40 year old Hispaic males B. 21-35 year old White Males c. 65+ year old White females D. 18-35 year old Black Males Duh!! D. That is their demographic. If You were setting up a conservative talk radio station and wanted feedback from your "standard demographic" would you choose: A. Black males 18-35 C. Middle Eastern immigrants 18-40 years old D. Social Security/Welfare scum over 30 E. 25-45 year old middle class yuppies I happen to know the demographic that they are looking for. 25-45 yearl old middle class whites. That is 80% of their demographic. In my business I know exacly who my customers are. I am a small business with a very few list of customers. I have 1 black customer, 2 hispanics, 2 women and the remaining 90% are white males over 50. If I were to want input on how to run my business better, and cannot effectively survey everyone, who would I get input from? the 1 black customer? The 2 females? Maybe the 2 females want me to paint my business pink and paint flowers on the walls, thus running off 90% of my customers. I can promise you that no person in business cares about your nationality, race, age or marital status. I can tell you that I care that my customer gets what is needed, engages in the same hobby (directly related to what I sell) and thinks about me in the future when they need more stuff. They care that I can talk to them about their hobby from a sales standpoint and because I too am an enthusiast. This is the same in the marketing gig. I think you may need to remove the chip from your shoulder dude.

But NEVER have I actually seen a post from someone so desperately seeking a lawsuit. You seem like one of those people who would pour water on the floor in a supermarket, fall down dramatically and call it "negligence" to make a profit. GIVE ME A BREAK! Focus groups are conducted to gain insight to a particular demographic's opinions and feelings on a subject. What makes you think you are OWED the opportunity to participate in a focus group for which you do not fit the desired demographic? Your opinion would not make a difference in the outcome and you would be wasting the time of all parties involved (including your own). Did you just want them to humor you and let you participate while ignoring what you're saying? This is ridiculous. Maybe you should focus your efforts on something more productive and stop clogging our justice system with frivolous lawsuits. I hope the judge laughs you out of the courtroom. Lose the sense of entitlement. No one owes you anything.

STATEMENT OF FACTS; On September 19, 2006, I filed a complaint on RIPOFFREPORT.com charging Schlesinger Associates Inc., and KTAR News Radio 620 with racial discriminationin violaation of 42 U.S.C. Section 1981, which makes race discrimination illegal in the making and enforement in the performance of contracts. During the previous two (2) months I attempted to contact Steve Schlesinger (owner), Mr. Sullivan (president) and their Legal Staff Howard Schlesinger (Attorney) to respond/settle the above claims of discrimination. The above attempts to contact were made by emails, fax, phone calls and by registered certified mail. Schlesinger Associates ignored my communications and never responded,whereby I filed racial discrimination claims with Federal, State and local entities. I am an Independent Contractor and have provided independent contracted opinions for Schlesinger Associates Inc., on one occassion before I was discriminated against on July 23, 2006, by this marketing research company. On February 16, 2007, a female friend (name ommitted to protect the innocent) oof mine recieved a email from [email protected] which stated in part; "Schlesinger Associates.......invites you to share your opinions in a group discussion .....to compensate you for your time and opinions, you will be paid for your participation......you will be required to successfully pass the screening criteria determined by client. This group will be held on Feb. 26, 2007. Please ask for Connie for screening." On Feb.7, 2007, my female friend phoned Connie at Schlesinger Associates for screening and successfully passed the required criteria and was scheduled for the focus group project to be held on Feb. 26, 2007. Connie further asked my female friend if she knew of any others who would like to participate, have them call her. On Feb. 17, 2007 my female friend gave me the name and phone number to call to be screened. I immediately called Schlesinger Associates and requested to be screened. The interviewer asked my name and I was transfered to Schlesingers Facility Director, Mrs. Trina Beaudreau Costellowho informed me that I must speak with Schlesinger 's Legal Staff (Attorney Howard Schlesinger) before I could participate. She goes on to state; "I will email Howard in New Jersey and he will call you today." Well, 3 days passed and recieved no call from Howard. Finally, on Feb. 21, 2007, I phoned Mrs. Costello and asked "why" Howard never called? The following phone conversation occurred between Trina Costello and myself. Trina goes on to state; "I just spoke with HowardSchlesinger and he says, 'we do not want the opinions of your kind' at any of our focus groupsbecause you slandered our company on Ripoffreport.com. Attorney Schlesinger advised me to erase all your information from our files and to delete your name from our data base. I am taking his advise and deleting your name as we speak," Further Trina adds; "Also tell your female friend that she is not welcome at any of our focus groups." I asked Trina "why?" Trina states; "because she is associated with you, and I am deleting her name and information from our data base also." I informed Trina that my female friend had already passed the required screening criteria for the Feb. 26, focus group. Trina, the Director of Schlesinger's Phoenix branch stated; "tough tittie" and hung up the phone. (my female friend was barred from the focus group and never attended.) I informed my female friend ofTrina's decision, and my friend called Trina and was basically told the same thing. Then, my female friend called Howard Schlesinger in New Jersey to inquire as to "why" she would not be allowed to participateon the Feb. 26, focus group. Attorney Schlesinger told my female friend that; " Schlesingers clients does not want the 'opinions of your kind' at our focus group projects. Attorney Schlesinger goes on tho state: "If you write anything derrogatory on a Ripoff report, then I will sue you." My female friend told Attorney Schlesinger; "fine, then read about it on the internet." THE LAW: Surely, Attorney Schlesinger must have known that he cannot advise his clients to destroy Corporate data base legal documents (relevnt, pertinent,exculpatoryletters, recruiting and interviewing recordings) if it is forseeable that these records would be relevant evidence in a planned civil action. Attorney Howard Schlesingerviolated the NEW JERSEY CODES OF PROFESSIONAL CONDUCT. (1.) lAWYERS MUST NOT PARTICIPATE IN CONCEALING OR DESTROYING EVIDENCE. (2.) LAWYERS MUST ADVISE CLIENTS NOT TO DESTROY EVIDENCE,OTHERWISE, WILL BE GUILTY OF OBSTRUCTION OF JUSTICE. Moreover, Schlesinger Associates Attorney Howard Schlesinger and their Director, Mrs. Trina Costello, RETALIATED against me for practicing my First Amendment right to seek redress for the racial discrimination they perpetrated on me, by denying my female friend access to thier focus group where my friend had successfully passed Schlesingers required criteria. Attorney Howard Schlesinger violated the following: (1.) TITLE VII of the Civil Rights Act (2.) 29C>F>R> part 1604.11 (3.) EEOC compliance manual, section 8, retaliation (4.) EEOC compliance manual, section 2, Threshold Issues CONCLUSION: Where is Attorney Schlesingers good moral character, i.e., legal ethics and professionalism? Attorney Schlesinger intentionally spoliated evidence that is essential to the successful completion of an on-going investigation.

If you are "fully aware of the entries in the Book of Mormon and their historical (racist) views of African Americans," that is based on their percieved tenets (facts), then why is it you continue to challenge me on the Mormons racism ? I did not write those veiws. Please, allow me to set the record straight. "There is no God until SCIENCE proves the existence of God." Therefore, I do not practice religious discrimination, I treat all religions equally. In my opinion, all religions are 'gang related',if the modern day Gangs, add a God to their doctrine and a couple of ancient symbols, signs and sayings to their criminal doctrines and register as a religion, then they should be accepted legally and have the respect as other religious gangs have. Religion is used to discipline, control, influence the ignorant into submission. Don't get me wrong, these ancient writing are excellant for personal conduct and society however, the concept of God, heaven, hell along with the supernatural occurrences, mysteries such as being born without a father, raising from the dead, afterlife and so on, I will only believe when SCIENCE proves the existance of such. It is a "given" that Schlesinger Associates discriminated against me with their own procedures, however, KTAR and Bonneville International set the parameters for this specific focus group (Mr. Erik Hellum) has already accepted "full responsibility" for the actions of Schlesinger Associates but has failed to retify the damages and injuries to me.(pursuant to my complaint, I did not state each and every fact in this temporary complaint as I am a layman of the laws.) However, the above corporate entities will be held liable according to Respondeat superior, Vacarious, Secondary, Contributory and Contract liability laws. Furthermore,I do not accuse the entire Mormon religion of racism for the actions of a specific group within their religious organization. However, Emmis Communications and their affiliated entities have a custom and practice of discrimination against African American culture (please, GOOGLE Emmis Communications discrimination or racism.) Also, Emmis communications has a custom and practice of purchasing Hip-hop stations (culture)across America, downgrading their programming enven if the hip hop station is the most listened to station in that State, such as Power 106 in Los Angeles, Z 104. in Washington, DC, KKFR 93.2 here in Phoenix,and others across america. Underground hip-hop music , is the cultures soldier, because it stands for what hip-hop's foundation is formatted on , which is rebutting societies view of urban community and engenuity, which the powers to be, find as a threat. Any venture, that challenges the mind of young African american and Latin american concept of history,culture and gaining self-empowerment, is being neutralized by the Emmis Communications and affiliated religious entities.. Again, hip-hop is not the issue here but through my research I find that Discrimination is the means that is being utilized to further the racist tenets of their religion, i.e.,by setting the parameters to exclude african american opinions and violating U.S.C. 42, Section 1981, which makes race discrimination illegal in the making and enforcement in performance of contracts. Aafes, I apolgize for getting off track but there's more to my lawsuit than meets the eye, I have aproximately a year and a half to complete my research and file the actual lawsuit in court. No, I do not "selectively" read. I read your entire post. I am fully aware of the entries in the Book of Mormon and of the Church of Jesus Christ of Latter Day Saints historical views on African Americans. My post, in regard to discrimination, if you read it, pointed out simply that your own statements indicated that you practice religious discrimination. Discrimination cannot be justified based upon historical occurences. A historical writing that discriminates or the historical actions of a group that may follow the tenets of the writing cannot justify your discrimination against them as individuals or as a group. The statements you indicate Ms. Boudreaux made indicate that if there was exclusion or discrimination Schlesinger was responsible for it, not Bonneville International, the radio station, Coleman (Or the Latter Day Saints). In one of your posts you indicated that all the parties you seek to hold responsible EXCEPT Schlesinger are owned by Latter Day Saints. Schlesinger's representative stated directly that it was THEIR policy that excluded you. In turn you are entering into bigotry laden diatribes against the Latter Day Saints - yet you have indicated NOTHING that states any of the businesses owned by Latter Day Saints excluded you, rather that the ONE business not affiliated with them did.

The above chapters explains the historical racism in the Mormon church and is based on their precieved facts. These verses demonstrates the racial and religious bigotry of the Mormon Church based on facts in the Book Of Mormon.Furthermore, African Americans were not allowed to attend religious services until 1978. These verses only touchs the surface of racism in this organization and not worth entertaining on this website. Secondly Aafezzzz, African Americans are in all 'sectors' of the population, the owner cannot select only 'whites' and simply exclude 'blacks'based on race, especially african americans who qualify. Thirdly Aafezzz, I stated that my wife attended the focus group and observed their were no african americans in the 6:00 p.m or 8:00 p.m focus groups. Mr. Aafes, here's a little knowledge(FYI).African Americans are in all "sectors" of the American population (not sure about in Germany), the owner canot select 'only whites' and to simply exclude qualified blacks, based on race, in American society (not sure about German society). The "indications of religious bigotry" that you claim I promulgated are based on fact, proof and evidence of the Mormons historical past. I suggest you read the above chapters of the Book of Mormon before making "unsubstantiated, frivoulous and erroneous misstatements." Furthermore, Mr. Aafes, I stated that my wife attended the Focus Group and she observed "there were no african americans present." A focus groups is a marketing tool to test ideas prior to spending money in a particular consumer market. It is not a job offer. You stated that the new owner of the station had already made a decision on the format of the station, conservative talk radio. If the owner elected to survey only a particular sector of the population that is simply his choice. You provide no evidence that the "quota", as you say was the term used, had not INDEED already been filled; and if so, then the inclusion of minorities in previous or subsequent groups disproves your theory of discrimination. Your posting here, if the defendant elects to use it in court, belies your own discrimination. You made several indications of your own religious bigotry toward the Church of Jesus Christ of Latter Day Saints. One definition of discrimination is "Behavior that shows prejudice. Failure to treat people equally because of a bias based on race, gender, RELIGION......" "If thou would remove the mote from thine neighbors eye, first, remove the beam from thine own"

Bonneville International Corporation Jeff Smulyan - CEO 55 Norht 300 West Salt Lake City, Utah 84180-8 Emmis Communications, Hq. Jeff Smulyan President 40 Monument Circle 700 Indianapolis, Ind. 46204 Please do not make Contracts with the above Corporate entities or their affiliates because they discriminate , falsely accuse innocent parties and speak with a forked tongue. STATEMENT OF FACTS; (a.) KTAR News/ Radio 620 is owned by Emmis Communications and their affiliate Board of Directors is Bonneville International, with Jeff Smulyan being the CEO of both Corporation. Bonneville International's mission statement and core values reads: "We set the stndard for how business is should be done." I attempted to contac Mr. Smulyan and Bonneville internatin serveral times by Certified and Registered mail but to no avail. (b.) Schlesinger Associates,Inc., is owned by Steve Schlesinger, with Corporate offices across America, including but not limited to Phoenix, Arizona wher eMs. Trina Beaudreau is the facility director at the Schlesinger branch here in Phoenix. (c.)Mr. Erik Hellum GM for KTAR News/Radio 620 and property of Bonneville International recently purchased a local hhip-hop radio station (KKFR 92.3f.m) located in Phoenix, KTAR will change the programming of this hip-hop stationand replace it with a Conservative news and sports channel. (d.) KTAR/Mr. Eruk Hellumhired Schlesinger Associates to conduct a Focus Group Project for its Radio station.The aim of Schlesinger Associates (supposedly) is to collect data (opinions) from the many KTAR listenersas to what programming should be aired on KKFR that willreplace the local hip-hop station. (e,) Mr. Erik Hellum claims:" KTAR serves a great racial diversity of listeners in the Arizona Community." (f.) The demographics of KKFR (hip-hop station) is young white, latino's and african americans. (g.)Schlesinger Associates Inc., contracts with individuals to participate in their Focus Group Research for their opinion and are compensated accordingly from contractual obligation from companies who set the parameters. THE LAW; UNITED STATES CODE TITLE 42, CHAPTER 21 states: "prohibits discriminationagainst persons based on age, gender race, national origin and religionin a number of settings." UNITED STATES CODE42, SECTION 1981 states: "makes discrimination illegal in the making and enforcement in the performance of Contracts." ARIZONA REVISED STATUTE - 41-1492.02(F)(1)reads: "The imposition or application of eligibility criteria that screens out or tends to screen out individuals..........." The above Corporate entities violate the First and Fourtenth Amendments to the Constitution by denying me an equal opportunity to participate in and express my opinion based on RACE, whereas, I was otherwise qualified. STATEMENT OF THE CASE; On July 23, 2006, an employee from Schlesinger Associates phoned me requesting my permission for an interview for a Focus Group Project. The subject matter to be discussed was regarding "what radio/talk show do I listen to?" I could not immediately remember so I asked my wife and she assisted me during the interview and KTAR was mentioned . Ms. Anderson continued qustioning me concerning my age, employment, salary and basic lifestyle. I asked Ms. Anderson, how is this interview going and she stated the interview is going well, I have just one more question to sk regarding your race?" I informed Ms. Andersonthat I am African American. Ms. Andersonreplied that;"I did not qualify for the focus group due to the quota for African Americans had been met." Ms. Anderson remembered that my wife had assisted me during the interview and asked the race of my wife? I stated my wife is Caucasian. Ms. Anderson then asked to speak with my wife and soon qualified her for the focus group that i did not qualify for. The focus group that I am referring to was held on Wednesday, August 3, 2006 at 6:00 pm. On August 3, 2006 , my wife attended this focus group and observed there were no african americans present at Schlesinger focus group research.In her group there were 16 people, who were divided into two groups of eight. When the 6:00 pm focus group had ended , my wife walked out pass another group of 16 people waiting for the 8:00 pm session to begin, this group was also to be divided into 2 groups of eight, she observed there were also no african americans in either of the two groups of eight. Since the above discriminatory acts wee perpetrated against me by the above corporate entities, I have communicated with Trina Beaudreau, the facility director at Schlesinger Associates. Ms. Beaudreau stated that:"We did not discriminated against you, however, we did not want the opinions of africn americans because we are purchasing a hip-hop station that african americans are accustomed to listening to." Furthermore, she stated:"When we don't want certain groups of people to share their opinions with us, we simply inform them that the quota has been filled for tht specific group." During this conversation, Ms. Beaudreau points the finger (blames)at KTAR by stating :"we do not set the parameters for the focus group, you should speak to the General manager of KTAR." I spoke to Mr. Hellum, at first, Mr. Hellum states, he never heard of Schlesinger Associates, then a few days later he states: "I hired another Corporation to actually conduct the focus group, they're the one's you must contact not KTAR. Mr. Hellum deliberately providded me with false info. but I trusted Mr. Hellum , I thought he was a man of honor, integrity and principal, so I went after this corporation by involving the good name of this corporation with the likes of Schlesinger and KTAR.During this process, I scandalized and slandered the wrong company. (See the apology I prepared the this inncent company in COMMENTS.) On September 15, 2006, I recieved a letter from Mr. Hellum stating that: "KTAR did not engage in any actionable conduct towards you, nor did KTAR cause you any 'injuries and damages'that are legally compensable." The above entities do not accept any responsibility for the discriminatory acts they perpetrated against me, if they discriminated against me then its happened to other african americans who did not qualify due to their racists activities and attitudes. On October 19, 2006 I recieved a letter from Attorney's Steptoe and Johnson, the lawyers for Bonneville International Corporation and KTAR News/Radio informing me that the Information Mr. Hellum gave me was "incorrect" in other words he lied about the corporation he claimed caused the discriminatory acts. Mr. Hellum effectively caused me to slander and scandalize an innocent party in order to get himself out of the fire. Mr. Hellum obfuscated the facts and intentionally evades responsibility. Mr. Hellum deliberately caused another Corporation egregious harm, while at the same time, Emmis Communications and Bonneville International quietly acquiesced and tacitly approves of KTAR's and Schlesinger Associates racists ideas. As to my injuries and damages, well I have dignity, pride, feelings and I was humiliated and insulted not to mention the lost of consortium. This one phone call from Schlesinger Associates performing one act of racism for KTAR News/Radio really has changed my life. Tis is why these Corporations will be sued for the sum of $70,000.00 thats Seventy Thousand Dollars. The statute of limitations in this matter is 2 years, so the above Corporate entities have at least another year and a half to hear from me before this law suit will be filed. CONCLUSION: KTAR hired Schlesinger Associates to target a specific groupof people (Caucasians) and to exclude all african americans due to the color of their skins, regardless of the content of our character. Not all african americans listen to hip-hop, just as all african americans are not democrats. African americans are a diverse group of peopleboth economically and politically, yet I was treated differently at Schlesingers Associates focus group project because of the color of my skin. I am Benjamin, the author of the complaint filed against the Coleman Research Group,Inc. on September 19,2006. Dear Mr. Kevin Coleman, you have my deepest and most sincerest apology for the slanderous and scandalous allegations and claims I made concerning discrimination and the violation of my civil and constitutional rights against the Coleman Research Group,Inc. It was not my intentions to falsely accuse an innocent party and I want to set the record straight and furthermore, do the right and decent things to prevent any unnecessary harm to The Coleman Research Group,Inc. First, KTAR News/Radio 620,their General Manager, Mr. Eric Hellum that is owened by Bonneville International Corporation, and Schlesinger Associates here in Phoenix, Az., owened by Steve Schlesinger based in Edison, New Jersey, did indeed discriminate against me, based on race. The above incident arose when on September 15,2006, Mr. Erik Hellum of KTAR news/radio 620 communicated with me via a letter indicating and intentionally providing me with false information stating that he hired your company (Coleman Research Group,Inc. based in New York) to conduct a focus group research for his company radio/news company (KTAR). Secondly, I made the mistake of trusting Mr. Erik Hellum, I believed he was a man of principal and honor and truly wanted to assit me in discovering "why" I was discriminated against by Schlesinger Associates and KTAR but instead, Mr. Erik Hellum only provided me with false information that in turn damaged the good name of Coleman Research Group,Inc. Thirdly and fianlly, once again I honestly regret having involved your companies good name next to the likes of Schlesinger Associates and KTAR news/radio.
