I am writing this report similar to another report filed for same reason.

Sears Home Improvement not only rips off consumers by charging 3-4 times the market rate for the same work and materials, they are also in the practice of back charging their salepeople based on third party 'Sears (not so sears)' installers.

I was employeed in the Boston office and was told I was a top producer in that office during my tenure. I worked excessive hours, traveled excessive distances, and was not on any type of corrective action.

After I quickly realized (6 months) that it was costing me more to go to work than I was making, I took a better look at my commissions, and well, Sears was backcharing me on the basis of vendors backcharing them.I had valid signed contracts which I am paid a full commission whether or not the job is backcharged by the contractor.

The irony was, the vendors were (and documentedly so) ripping them off. Sears simply passed the buck to the employees. Managers were well aware of this process and only cared about there bottom line. They really did not care about the sales reps.

I am taking my issue to the Mass. Attorney Generals Office and under House Bill 1059 ( Passed and accepted by Mass Supreme Judicial Court) file a claim and complaint against Sears for unpaid commissions. This will be a treble damage award under the Wage and Hour Laws.

Their mis-management of employees, and vendors, very often extended to those poor over-extended credit customers with lack-lustre installations.

I don't know if you read my report, but I've filed with the Oklahoma Dept. of Labor and an Administrative Order of Determination was issued in my favor. Sears has of course appealed it. Nevertheless, thanks again for the information you shared. Our hearing is in February and I truly hope to win based on principle alone.
