I ordered two magazines from this company from a door-to-door sales-person going by the name "Gina Frostad" -- which I am now sure was a fake name. For a total of $70 United States Dollars. The checks were cashed, and I was guaranteed I would receive the magazines in 120 days. This transaction took place April 11, 2002. It has been 289 days now since I was (I believe) defrauded. I have receipts and I have a certified letter receipt from a notice I sent to the company (with their signature, showing they received my notice, then ignored it) at their P.O. box demanding either a refund, or my magazines. I have received neither. I have filed this same complaint with the Attorney General's Office of both California (where I am) and Arizona, as well as with the FTC. Please help me seek justice for this situation.

My pending lawsuit against this company has hit a snag. After they were contacted asking for the appropriate name and address to serve court process with, they seemed to have been scared enough to actually submit one of the two magazine subscriptions to the publisher. Without damages (lack of the magazines I paid for) I cannot sue under the original terms I was going to sue under. I could still sue for breach of contract (their receipt says the magazines will be delivered much sooner than they actually were) -- but it would be a lot harder to get anything accomplished under those terms. However, the second magazine I ordered from them still hasn't been delivered, so the lawsuit may still be able to go forward, but now my attorney has to re-draw all of the court documents, etc. and we need to wait and see (for at least a month) if the other magazine is on its way. This may be a good precedence to set though, contacting these scum bags and letting them know that you can and will sue them (don't say it if you don't mean it), and asking for the appropriate name and address to server court process to, seems to do the trick into scaring them into doing what they were supposed to do in the first place. I will keep everyone posted.

I have contacted these frauds on several occasions through their 800 number, and also through certified, signed receipt mail through the USPS, demanding my money back or my magazines. They have been playing the waiting game with me, and I have had it. It has been over a year since they commited their fraud with me (and they are STILL contesting my shipping address with me, even though I have documented evidence that proves I notified them of my correct address). The final straw came when I spoke to one of their "supervisors" (I am sure this is just a group of scam artists running this fraud out of a trailer somewhere) and she told me that one of the two subscriptions I had ordered had been placed with the magazine company, and should be in their system. I *CALLED* the magazine company, and not only did they not have my order in the system, but they had never heard of "Services Unlimited Plus -- which tells me they aren't submitting *ANY* magazine orders as a re-seller. So here is the deal. I am going to file a lawsuit against these people on the grounds of fraud (across state lines no less) and on the grounds of breach of contract (a receipt is a contract). I would like to make this lawsuit a class action lawsuit, because class action lawsuits tend to carry more weight (although there isn't much of a pay-off for the members of the lawsuit -- but I am not doing this for the $75 I lost, I am doing this for justice).
