Shadowshopper ripped me off 99.99 for not reading their hidden print and hidden membership signoff instructions to prevent me from closing my subscription, thereby automatically signing me on for a year and charging me these unapproved fees. They are rude and insensitive and refuse to work with you!

How can they live with themselves tricking people out of their hard earned money! Shame on them! They trick you into a corner with no recourse! DO NOT EVER DO BUSINESS WITH THEM!

EDitor's Suggestions on how to get your money back!

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

CHARGES TO YOUR CREDIT CARD

If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here.

Remember Don't let them get away with it! Make sure they make the Rip-off Report .. The more Reports filed on a Company or individual, the more likely it is that the authorities, media and attorneys will want to take action.

And good luck Let us know how you do!

Here is a copy of an email that I sent Johnathon in 2005...does not sound like someone whom did not try to cancel does it? Also as you read his email you will realize this is a company that wants to get paid for nothing...I was not using the service for the entire year billed but he still kept my money. UNETHICAL!! WARNING ALL YOU HARD WORKERS....stear clear!!!!! Date: Wed, 9 Feb 2005 23:21:00 -0800 (PST) From: "Teresa" Add to Address Book Add Mobile Alert Subject: RE: RE: DISPUTE To: --- As stated I did not authorize and I have made several attempts to cancel. This is the first confirmation of cancellation that you provided but I just received another email from you 3 days after confirmation of cancellation. The bottom line you did not deliver as promised 90% of your emails were repeats and I do not wants your service what kind of company makes you pay for a service not only do you not want and do not receive but you are basically charging me for nothing! I will dispute with my credit card company as stated earlier I hope they will protect me from this sort of fruadelent behavior. I say I cancelled you claim I didn't I don't want your service yet you still charge me for nothing! Not very fair is it? [email protected] wrote: You did agree to the charges by checking the box saying "I have read and agree to the above terms and conditions." and we have done nothing illegal. You did check the box that says "I have read and agree to the above terms and conditions." not only once but twice. You agreed to the terms of service for the first time by checking the box saying "I have read and agree to the above terms and conditions." on 10/02/04 when you registered for a Bronze free membership. You agreed to these terms again for a second time by checking the box saying "I have read and agree to the above terms and conditions." on 10/03/04 when you upgraded your membership to a 30 day trial membership. On 11/03/04 your membership was renewed exactly as stated in the terms of service you agreed to, because you did not cancel or notify us that you did not want to continue your membership. On 12/10/04 you cancelled your membership. You had over the 30 days to notify us if you did not want to continue your membership, which you did not. I will be more than happy to reactivate your membership for you but I can not issue a refund ________________ GEE he will renwe my membership...how honorable! Besides you will receive no real leads from this company!

Teresa was notified in at least 6 different places about the automatic renewal to her membership (listed below). This could only come as a shock if the information was not read and followed to prevent it. I find it difficult for someone to not be able to pay attention to details when that is what the number one requirement is for a mystery shopper. 1. TRIAL DESCRIPTION ON ORDERING FORM (before joining in BOLD): And, if you're as happy as we think you'll be, do nothing and we'll automatically renew your membership when it expires. If you're not completely satisfied, just go into your account preferences to cancel your renewal anytime before your membership is up. No questions and no further obligation. 2. TERMS OF SERVICE (before joining): [Box you checked states, I have read and agree to the above terms and conditions. ] On the 30th day of your trial membership, your credit card on file will be charged for continuing membership at your current membership level, Silver or Gold, for the time period you have specified, either 90 days or 1 year, based on the preferences you have set on your Account Information page. You may request NOT to have your credit card automatically charged for renewal anytime during the 30 day trial period, by either changing your account preferences yourself on the Account Information page located at https://www.shadowshopper.com/myshadowshopper_shopper_account_information.cfm (select "I'll do it myself. Don't automatically renew) under Account Renewal Preference, or by emailing us a notification of your intent to prevent automatic renewal prior to the time of renewal. If neither of these actions is taken prior to the renewal transaction, you agree to pay the full renewal charge. NO refunds, for any reason, will be issued after the renewal transaction has occurred. You may choose to cancel your membership after the renewal transaction has occurred, however, no refunds will be issued, either in full or for the unused portion of membership. 3. WELCOME EMAIL (after joining) Toward the bottom of the email it states, And remember, if you're as happy as we think you'll be, do nothing and we'll automatically renew you for a year's membership at the end of your trial. 4. MY INFORMATION LOGIN PAGE (after joining) At very top of page it states, [first name] you are currently a ShadowShopper Level member. Your account is due to automatically renew on (date). 5. MY INFORMATION - ACCOUNT PREFERENCES PAGE (after joining) Under heading VI., the page states, Choose your account renewal preference. When your trial membership expires on we'll automatically renew your membership. We'll use your credit card listed above and renew your membership for One Year () 6. COMMON QUESTIONS PAGE (before joining) Towards the bottom of the page is the question, Will my membership renew automatically? Yes, all our memberships are set to automatically renew when your membership expires, for your convenience. You may request NOT to have your credit card automatically charged anytime before the renewal occurs, by either changing your account preferences yourself or by emailing us a notification of your intent to prevent automatic renewal. To change your renewal preference yourself, simply go to your Account Information page located here (NOTE: you must be logged in for this link to work). Select I'll do it myself. Don't automatically renew and click the 'update' button and your request will be immediately processed. You will also receive an email confirming your action for your records.
