I purchased a Reebok NFL Jersey (sku #883299085640) from Shirtique on 08/22/09 at 4:33pm. I paid for it with my Visa debit card. The total amount of the purchase including tax was $65.85. When I took it home and tried it on I realized it was a size too small. The football game was scheduled to begin at 5pm so I didn't have time to return to the store to exchange it the same night, I put it back in the bag and planned to return to the store the following day.

When I go to the store the next day, 08/23/09, the sales associate said he could not return it because it "smelled funny". I said that's impossible as it hadn't been worn. After convincing him that it hadn't been worn (the tags were still attached) he starts to tell me that they have a policy that states items cannot be returned after a big game.
I asked him what he meant and he said whenever there is a "big" game merchandise cannot be returned that was bought on the date of the game. When I asked him where was this in writing, he said it isn't in writing that it just "is". I told him that he could not enforce a policy that is not in writing and he kept repeating "sorry that's just the way it is".
I wasn't trying to get a refund, I was only trying to exchange the jersey for a larger size. My complaint is that the term "big game" is incredibly subjective and even if they were going to attempt to enforce such it should be in writing.
