... accepted telephone order in the amount of $500 on 3/8/05 for assorted auto parts; charge in that amount was posted to credit card that day. Was told by salesman "Don" that parts would "ship within 10 days". We are now at 21 days and no delivery. Numerous emails and voicemails left at "800.456.8144 x210" have gone unanswered.

According to the Upstate NY BBB, "On January 20, 2005, this company's membership in the BBB was revoked by the BBB's Board of Directors due to a pattern of complaints and failure to eliminate the underlying cause of the claims."

It is my understanding that it is illegal to post charge to credit card in advance of product actually shipping. Please advise as to the accuracy of this point of view. Thanks in advance for your assistance.

two items of note have occurred: Friday 5/19, received word that the Credit Card company had refunded the $500. Monday 5/23, got letter from NYOAJ regarding issue & requesting more information, which I will gladly provide.

Googling "S&J" turned up our friendly neighborhood business owner "John" quoted in a Sept. 1999 article available from the web ...

The URL is (I hope it makes it): "http://albany.bizjournals.com/albany/stories/1999/09/13/focus3.html" I sent a "letter to the editor" of that publication pointing out the current business practices of our favorite auto supplier. Their response was: "Hi, Thanks for the note and the Web site. I had never seen that site before. It is something we should be aware of." The website referred to above is this one. I have also initiated correspondence with a TV station in Albany NY, WXXA - Fox 23, inquiring as to whether or not they have a "Hall of Shame" similar to what the FOX station local to me runs as a regular feature. You can readily imagine what is covered by that ... If they do I intend to pass along all info available regarding S&J in the hopes that they'll be featured on the air.

Regarding S&J Used Auto Parts Inc ... Have entered complaint with the Federal Trade Commission and started the process of disputing the charge with BankOne / Chase, the holder of the card which was charged $500 on 3/7/05
