 PLEASE PLEASE PLEASE!!!!! people No Matter how bad you need a car. DO NOT buy one from these people. they will ruin your life. Not only do they lie and are sneaky and will embarasse you to your friends neibors and relatives but they will ask you if you want your tires rotated for free or an oil change, anything just to get your car in their shop, and then they put tracking devices on the vehicle and kill switches so they know where you are at all times so they can cut the car off so it doesnt start when ever they want with out telling you. Trust me this is just part of it. They acually tracked me down and called my dieing mothers hospital room to see what time I would be bringing my payment in that day because it was 1 oclock and they didnt hear from me yet and it was due that day. I swear to God this is true. And then when I told the lady I really didnt know what time because my mother is dieing and they called the family to come down, she acually said to me I need a time or we will have to come pick up the car today. Not even to mention the fact that they sell HORRIBLE cheap cars, nothing nice, they get these auction cars that they pay nothing for and sell them for 20 times their value buy the time you are done paying the outragous intrest payments. and also dont expect your credit to ever get better like they tell you because they dont report anything to the credit people thats good or any of your payments because it costs them to do this so they dont report unless they repo your car then you will have a repo on your credit. PLEASE dont buy HERE!!!

 You are spending so much time trying to hand off YOUR responsibility you don't even know what you are talking about.

You stated the following two things...

When they sell a car worth $2500 for $17,000 thats taking advantage of people like me. when they collect over $11,000 of that $17,000 they have already made 400% of their investment back.

The only thing was that when I signed and bought the car it was with a totally different company.

- Do you see ANY issue with those two statements?  If you have problems I underlined a few of the words that may give you a bit of a hint.  Still don't know..okay well let me help you out.  You are complaining about THEM selling you a car when they didn't sell you the car.  They only bought the "note" 6 months after the dealer sold it to you.  They had NOTHING to do with the sell price, they had NOTHING to do with the Interest Rate, they had NOTHING to do with anything about the loan.  The only thing they are doing is requiring you to continue to pay on the legal agreement you signed when you bought the car.

As for your credit.  Okay, was there anything in the contract that says the MUST report it to the credit reporting agencies.  My guess is NO.  So while a bummer is NOT a RipOff as they are under zero obligation to do it.  It doesn't matter what the original company told you.

But this is a bit confusing also.

 I was only 2/3 of my loan paid and had another 10k to go and none of the payments would do

- If you have paid 11K on a 17K car, exactly how do you get to 2/3 of the total balance and $10,000 more to go?  What math are you using because unless you are leaving something out, it is not any math that is taught on earth.

Now, the other thing is you have still failed to answer a very important question.  What is your payment history like with them.  You have not denied you have been late. 

But if you are going to let the car go to Repo as you infer because they are not reporting it to your credit then it is very obvious to see why you are now and will always be with a Sub-Prime lender.

This last comment was 100% correct. However, These types of places take advantage of peoples situations they are in at a certain time. I knew The second I read their ripoff contract that I should walk from this its trouble!! but because of my current situation and them bending my ear that I will repair my credit buy doing this I made the choice to get ripped off. The only thing was that when I signed and bought the car it was with a totally different company. for the 1st 6 months it was fine I made my paymnets and my credit score went up 100 points. It wasnt til I had the car for 6 months. I got a letter saying that another company had taken over my loan (smart Auto) and nothing would change for me just the name. everything in the contract would be honored and they had a new address if i needed any service. I just happened to sign up for credit monitoring and seen that my credit report on all 3 bureaus did not show any outstanding car loan or any of the payments that I made. I contacted smart auto and they said It would be on my report soon they are in the process of updating the credit files. I told them right then that I didnt ask to be with you people and didnt know how I got here. They said its legal and loans are sold all the time it wont effect me. I continued to check my credit and no loan showed and no paymenst were reported. I called again and was told It will show up soon. a year later and they still did not report anything. I checked further and found out that Smart Auto does not report and payments to the credit bureaus becuse it cost them money to do that every month. They only report to the bureaus if people get repoed or the loan gets bankrupt. It was right then that I knew Smart Auto was just a lowlife rip-off place and I was stuck bigtime. I was only 2/3 of my loan paid and had another 10k to go and none of the payments would do me any good to boost my credit like I was promised when I bought the car. I was bound by the contract I signed even though it was with another company and Smart Auto didnt have to report any of my payments or my loan. I got ripped big time and would like to let others know to STAY AWAY FROM SMART AUTO!!!

Throughout time, including now, there have always been people that will try to take advantage of a consumer in any way possible. It is up to the consumer to say "NO". The scammer or rip off artist or unsavory vendor, whatever name you have for these people, can not rip you off if you refuse to participate. We as consumers have to look out for ourselves or we will get hurt by others looking to take advantage of us. It is totally up to you what you will buy and how much you will pay for it.

Once you understand that you have the ultimate power to say NO, then you won't ever be ripped off or scammed.

The whole purchase of the vehicle was up to you. You could have said no at any time. Once you saw the contract for $17,000 then you should have never signed it, especially since you knew it was only worth $2500 according to your post. At that point, you should have walked away.

However, once you signed the contract, it became your problem. You can fix this now by refinancing with your bank or credit union. If you can't refinance it because it is too old or has too many miles or your credit isn't worthy, then you are stuck until you can pay it off. Do your best to come up with the money and get that vehicle paid off right away. That is your only way out of this mess.

If you give it back, it is a repo and hurts your chances of buying anything else at a decent rate in the future.

The one good thing that comes from this is:  You now know the pain of having to fulfil a contract that you signed in haste. Hopefully you learned to not let someone take advantage of you again.

Smart Auto is a dump!! dont justify the things they do to people. Not only should they not have called me but they should have wiped out 2 or 3 payments for me do to the fact of losing my Mother. that would have been class!!

1st off anything can be justified. John Hinkley Jr. said he was in the right to shoot Pres. Regan.They are the ones who chose to do business with "people like me". there is a right way and a wrong way and a way of doing business with some class while making a tremendous amount of money off of "people like me". When they sell a car worth $2500 for $17,000 thats taking advantage of people like me. when they collect over $11,000 of that $17,000 they have already made 400% of their investment back. Not to mention making the expierience UNBEARABLE along the way. The country is in the shape it is in because these kinds of places are allowed the tactics they use to make this kind of money off "people like me". I just want to let "people like me" know, DO NOT GO TO SMART AUTO!!! It will ruin your life!! take the bus, ask for rides, buy a scooter but DO NOT GO TO SMART AUTO you will be a much happier person. and to all the people that work for this kind of place, I feel sorry for you to have to deal with "people like me" everyday!!!

 First, you must have horrible credit if you had to go with a company like this. Its unfortunate but its not illegal. It IS their property until you pay it off. Your credit is so bad that they cannot even let you miss one payment. Its not shady or sleezy for them to call and find out WHEN you are going to pay them. Yes we all understand your mother was dying. But that STILL doesnt change the responsabilities you have with them.

This is a situation ENTIRELY of your own doing. They have not ripped you off neither have they scammed you. I feel your just butthurt because THEY are holding you COMPLETLY responsible. Pay your bill on time and guess what...THEY WONT CALL YOU!!! Had you paid them WHEN you were supposed to, this would not happen.

Dont try and hold them to a higher standard then you yourself. If someone owed YOU money, you wouldnt CARE that they had a issue, YOU WANT YOUR MONEY!!! If you cannot pay your bills in a timely manner then perhaps you need to look at different forms of transportantion. I happen to know that mopeds and scooters are STILL a viable way to get around for short runs. A bike is free, and the bus is inexpensive.

Perhaps YOU need to fix your credit before you complain that someone is CALLING you to pay your bill. Because the reality is that this entire situation is YOUR FAULT. YOUR crappy credit score has caused this. And your credit score is a DIRECT reflection of your ability to PAY. Or in your case an inability to pay. Get over it. They are the only ones who would do business with you because of YOU.

And not to put too fine a point on it, why shouldnt they put in a kill switch. They want to make sure that THEY get paid. If you do not pay them, why should they let you drive around? Why should they let you have FREE USE of a vehicle that you do not own? See the problem, all of your issues here are really all about you. Stop being mad that the world isnt giving you a free pass. Stop writing negative reviews about a company that is JUST doing business. Unfortunatly they have to deal with customers like you. People who have crappy credit, crappy jobs, and no prospects to pull them out of that situation. YES they are going to make 100% sure that they either get their money or their car. Your embarassment is just a sad biproduct of your entire situation. You SHOULD be embarassed.

I'm going to go out on the limb here and say that you didn't exactly have the best payment history with them did you?

So just how many times were you late? 

Just how many of those times do you have various excuses that it wasn't your fault why you didn't make your payments? 

How do I know that this applies to you?  Well guess what you are with a sub-prime lender where you have not proven you can handle credit.  As such they are going to be a bit more active in making sure you make your payments.
