I got the 1st notice 11/05/10 the violation date 9/28/10 for a toll of $4.50 and penalty $100. We bought the car and transfer the title on 10/18/10 so I contact the South Bay Expressway sent in the proof of registration in November said I wasn't the owner of the car then this should be dismissed. Today they send another notice said:



"This letter is being mailed in response to your request for an administrative review. We have reviewed the citation related and our records indicate that the citation is valid. Your request for dismissal did not meet California Code requirements and has been denied. If you desire to contest the notice, you will have 15 days to pay the total amount due to South Bay Expressway, and request a hearing. If the hearing officer rules in your favor, you will receive a refund in six weeks"



Are you kidding me??!! paid and ask for refund later, what kind of business is this $4.50 toll and $100 penalty?! I didn't own the car then until 10/18/10. I don't live, work or have any business in South Bay. They didn't even send picture proofs, I will be complaint with BBB website next.

Hello Sir:

When a customer uses South Bay Expressway and does not pay the toll, we look to the Department of Motor Vehicles for information about the vehicles registered owner. When we retrieved the data for your license plate, the DMV indicated that you were the registered owner. You took the right steps by filling out the dispute and sending it to us with a copy of your registration. What was unclear to us was that you became the owner after the date of the citation. Your dispute indicated the vehicle was sold, and we understood that to mean that you sold it, not that it was sold to you. Now that we have more clear information, we were able to do some more research with the DMV and see that in fact, you were not the registered owner as of the date of the citation. We agree that it is not fair to be charged for trips taken on South Bay Expressway when you were not the registered owner, and well always do your best to make sure this doesnt happen.

We apologize for the inconvenience and any extra steps youve had to take to get these citations cleared. The citations have been transferred to the previous owner and there is no further action you need to take to clear the citations in your name. If you have additional questions, you can reach the Customer Service Center, Monday through Friday from 8 a.m. to 5 p.m. at 619-661-7070.

I am just wondering how a private company,  South Bay Expressway,  enforce

a  California Code.

seems they can only use the same means to collect  as another company,  or   is there some underhanded scheme going on here to get the  state gov. involved?

Forget the BBB! They are a corrupt and useless organization that has absolutely no power to do anything for you. Did you know that the BBB is a FOR PROFIT business?

Second, STAY OFF THE PHONE!! Phone calls and regular mail DO NOT protect your rights under the law.

ALWAYS communicate in any legal dispute IN WRITING and via CERTIFIED MAIL, RETURN RECIEPT REQUESTED, Always put the certified# in the body of the letter as this proves exactly what you sent. Keep a copy for your records.

By the means above, dispute their claim, refuse to comply with that stupidity, and DEMAND picture proof. Then re-attach your evidence, and re-send. Do a CC to the governor, DMV, and as many other applicable government agencies as you can think of. Also try contacting an investigative news channel.

These tickets follow the REGISTRATION of the vehicle, NOT the title. The registered owner at the time of the violation.

In my opinion, everything that is screwed up in this country originated in CA. Idiots.
