Auto purchase through ebay claim filed item not as described. Houston Motor Cars agreed to refund purchase in exchange for positive feedback. Money never received.

Ebay claim paid only $175. Square trade mediator charge $100. but no resolve.

Auto broke down, filed square trade claim to Warrentech. Claim denied because of Pre-existing condition. I spent over $5600. on the car that now does not run plus over $800 in repairs. I spent over $500 on a warranty that is worthless.

I believe Ebay is a fault for honoring Houton Motor Cars as a Super Seller despite numerous complaints. I am not the first. Also at fault is Houston Motor Cars as a deceptive seller. I have filed compliant with BBB, and Texas Department of Transportation Motor Vehicle Division but no response.

Also at fault is Square Trade and Warrentech for fraudulant warranty that allow denial of any claim due any pre-existing condition. Basically any used car has a pre-existing fault. I started this dispute on 10/11/2005. Today one year later, I have been

take for a ride by Square Trade, Warrentech, Ebay and Houston Motors. Buyer Beware, do not buy any car from Texas, do not believe any warranty from Square Trade or Warrentech, be very carefully buying anything from Ebay, they will not help you, you are on your own.

Buyer Beware.  There is a reason why used car dealers are listed as the least trusted profession, right below pond scum.   READ THE FACTS.  I can only hope that Nick, Houston Motors, cleancashcars has changed how they dealt with me.  If my efforts to confront their fraud and abuse has saved someone else then it has been worth it.  Why does Nick, Houston Motors or Cleancashcars have to keep changing their name?.  Contact the Texas Dept of Motor Vehicle Dealers Licensing and ask if there is any complaints filed against him.

My family and I have purchased numerous vehicles  including commercial vehicles from Houston Motor Cars & their affiliate Clean Cash Cars. I have nothing but praise for this business & highly recommend them to anyone in the market to buy a vehicle. Car buying is a process where buyer has to be involved in doing their own research. The employees I have dealt with have always been forth coming, upfront , professional & sincere about any representations. I have kept the vehicles for over night and over the weekend test drives before making a decision on them. A point to note is AS-IS vehicles do not come with any warranty from the dealer. It is the buyers responsibility to get it independently checked out. The dealer clearly states they are selling it AS-IS, nothing more nothing less. The vehicles that are sold on used car lots nationwide primarily come from Dealer auto auctions & resold to the public As-IS by most used car dealers. When expectations are too high & no personal research involved is when the problems occur. These guys are fair, reasonable & honest in my opinion.

I posted some suggestions on how to reslove an issues if you have on with any car deal. Nick has done the right thing by me, I can not go into detail what he did to reslove the issues I was having, but he has done the stand-up things. I am very happy with the outcome.

Nick is up too his old tricks, he now goes by Nick Noor. I would recommend to resolve any issues you are having with him by filing a complaint in Houston with Lemon Law Department for the City at 1-800-622-8682. That is the only way to have a paper trail to him. His new website is cleancashcar.com Good Luck

Brother, if something sounds too good to be true, it probably is. The nickname for EBay in the car business is "stealbay". The reason is that bidders generally want to pay about half of what wholesale is on any given car. If one of your bids actually wins an auto auction, I would be VERY suspicious of the car. I mean, common, that means the seller has less than half of wholesale invested in it? Trust me, the car is gonna have issues. I'm not saying every car on Ebay is a lemmon, just the ones where a rediculous offer actually beats the reserve and is the winning bid.

So here's the bottom line. Nick, and guys like him, buy cars from an auction, pretty them up at bit and if they bought right sell for a higher price on places like ebay. Through meeting him in person and talking with him extensively he is not a mechanical expert. He generally has NO idea of the history or status of a car. Obviously if it does not work, he would figure that out. He did do things that were not 100% forthcoming in my deal (a $15,000 car) but that's why they say buyer beware. He's just another guy trying to make a buck in the used car business nothing more nothing less. You could always go directly to an auction and buy yourself...but don't expect that to be risk free either.

congratulation to the individual with positive car buying experience with Nick and Houston Motor Cars. I am sure there has been some changes in their policies, however, this does not change the facts that I have a list of 5 other buyers with similar experiences as mine, also the Texas Dept of Motor Licensing Board has contacted me twice and confirmed numerous complaints, was told that Nick will probably not recieve dealer license renewal. Since issuing my complaint, Houston Motors is no longer on ebay. I do not yell and scream, I am a licensed reputable auto dealer in Lincoln, NE and expect to be treated honestly and fairly just as I treat others. Do not expect Houston Motors, Nick or company to be either.

I recently purchased a car on Ebay from one of Nick Velani's agents, Joe deHoyos. It was a 1999 Isuzu Amigo with about 77k miles. From the pictures and from the description, I felt I had gotten a good deal. I signed an "AS IS" contract with Houston Motorcars, where it was clearly disclosed to me that I was buying the car with no promises made or warranties expressed by Mr. deHoyos or Mr. Velani. About 3-4 days before I was scheduled to fly to Houston to pick up the car, I received a phone call from Mr. deHoyos informing me that the vehicle had developed a problem, and that I could opt out of the deal if I wished, and that he would refund all of my money. But he also said he was going to try to get the problem fixed, and that he would cover the cost even though we had signed an "AS IS" deal (at this point, they had all of my money as is usual for Ebay purchases). So, I said fine, let's see if he could get the car fixed. When I arrived in Houston, I was dealing with Mr. Velani, who met me at the airport with the news that the Isuzu was still not running properly, and that he was not comfortable having me take it back to Maryland until it was fixed. He then offered me another car for me to use on my side trip to San Antonio at "no charge" because he was concerned that I had been inconvenienced!! A few days later when I returned from my side trip, I met Mr. Velani at a location near the airport to exchange the loaner car for the Isuzu. Mr Velani had been told by the mechanic that the problem was solved, so I took if for a quick test drive, and the problem was still there at high speeds. When I came back from the test drive, I informed Mr. Velani that a problem still existed. At this point, I was out of time, because I still had a return flight to MD in case something went wrong, and that flight departed in less than 2 hours. So, Mr. Velani suggested that I take the loaner car to the airport, park it at the 24 hour lot, and he would pick it up later that day. Unbelievable! These guys did everything in their power to make this deal right. I received a 100% full refund, and thankfully, for these hard working honest guys, they were able to sell the car after it was fixed for $500 more than I had agreed to pay. In my opinion, this guy Mike from Nebraska had unreasonable expectations when buying his used car from Nick Velani. EVERYBODY should realize that there are no guarantees when buying a used car. I think this guy Mike from Nebraska probably started yelling and screaming and complaining long before he tried to work out a reasonable solution with Mr. Velani. My bet is if he had been decent and reasonable to Mr. Velani, he probably would have been handled as professionally as I was handled. The sad fact is that loud mouth jerks rarely get their way just because they yell and scream and complain; they would "get more bees with honey" as the old saying goes. Hats off to Mr. Velani and Mr. deHoyos of Houston Motorcars. They are just two nice, decent guys trying their best to make an honest living in an industry that is loaded with shady characters. I would recommend them to my friends and family without reservation.

Warrentech Responded

#12Author of original report

Tue, January 30, 2007

Warrentech has paid for a replacement engine after inspection by cerified mechanic verified engine failure due to sludge build up. The mechanic has also indicated the auto has many more miles on it than what the oddometer is showing. I agree that it is very sad when auto dealers knowingly sell vehicles that have issues to unassuming consumers. There is a reason why auto dealers are considered one of the least trustworth professions. Due to the practices like Nick at Houston Motors; good and honest auto dealers have to overcome a bad public image. WHAT I HAVE LEARNED. ALWAYS READ EVERYTHING AND THE FINE PRINT. NEVER BUY AUTO WITHOUT THIRD PARTY INSPECTION IF YOU CANNOT CHECK IT PERSONALLY. DO NOT BELIEVE WHAT IS SAID, ALWAYS GET ANY AGREEMENTS IN WRITING, SIGNED AND DATED. WHEN FILING A CLAIM, MAKE SURE IT IS DONE PROPERLY AND TIMELY. DO NOT USE EBAY MEDIATORS. JUST BECAUSE EBAY LISTS A SUPER SELLER, OR SQUARE TRADE OFFERS A WARRENTY DOES NOT MEAN THE SELLER IS GOOD OR TRUSTWORTH.

As an employee of Warrantech I can tell you that it is not, nor has it ever been our position to make assumptions of who did what to whom. I can honestly say that I find it hard to believe that an employee of our company would condemn either the dealer or the buyer. It is the buyers responsibility to know what they are buying and from whom, and it is the seller's responsibility to deal in good faith. The way it sounds to me is that someone whether it be the buyer or the seller did not do what they needed to do in order to secure a honest transaction. I find it funny that I get alot of the times people angry that we wont pay for an engine on something that they got off ebay. Typically the warranty they get is a free 30 day powertrain warranty that we honor for that time period and there is no such thing as pre-existing on them. Only a 2500.00 cap on the contract. The only time a customer is out of pocket on any of those contracts is when they decide to upgrade to a more extensive a broad termed coverage. So for anyone to be upset we would not shell out money for a new engine on a contract they got for free is kind of funny. Then again it is also dealers that knowingly sell vehicles that have issues to an unassuming consumer, that I find sad. Suggestion to all. Check out the business before dealing with them, and the business needs to have a legal document showing the consumer has had ample time to look at the vehicle and will accept as is. These kind of issues is what gives us (independent contract moderator) headaches, because we are the one's that get screamed at and we have nothing to do with the selling, writing, or pricing on the contracts.

HOUSTON MOTORS FRAUDLANT PRACTICES

#18Author of original report

Mon, November 06, 2006

Before purchasing the car on ebay,I telephoned Nick and reassured me on several occassions the auto was in excellent condition and ready to drive. The car was shipped by MAF Motor Transports to Oklahoma city for $600 my costs on 10/21/05. The transport bill of landing notes(AUTO IN POOR CONDITION). The auto was not drivable when received. Tires had metal cord showing, broken front hub assembly. Auto was inspected on 10/28/05 by Kenndy Tire & Auto Service of Edmond OK w estimate of $1276. repair needed. After repair were made it was obvious the engine had a knocking sound. It was inspected at Bob Howard Toyota of Edmond OK on 11/2/05 with an $7290 estimate of repairs needed. I telephoned Nick on 10/22/05 he said he would do what ever was needed to make it right. But after two weeks and only 25 miles the car was obviously a lemon. Nick and Houston Motors failed to respond to repeated request for compensation for a misrepresented auto. Claim filed w ebay and Nick agreed to buy the car back from me if I would leave positive feedback on ebay. Since leaving positive feedback I have not heard from Nick again despite multiple requests. I have learned of 4 other buyers who have had similar experiences w Nick & Houston Motors. Do not trust or believe what Nick or Houston Motors says or prints. They are liars and crooks. I have only driven the car 6000miles this year and now the engine blew up. I have lost over $7000. on this auto, and yes I am very upset. I have since learned the car was stolen, taken to Mexico and possible insurance fraud by a previous owner. I do not know if Houston Motors was involved but I would not be surprised. This car should have a salvage title. I have all the documentation and records needed to pursue legal action but the costs would not be worth it. Never buy a car sight un-seen, and NEVER BUY ANYTHING FROM NICK (NAUSHAD VELANI) OR HOUSTON MOTOR CARS SUGARLAND TX.

#19UPDATE EX-employee responds

Mike had the opportunity to Test drive the car , take it to his mechanic, get second and third opinions. This unit was sold to him in AS-IS condition. Car was worth over $10000. It was sold to him AS-IS for less then HALF its value due to cosmetic imperfections in a NO RESERVE auction. Mike knew he was buying it at a great deal. He admitted he was car shopping for deals for over 5 months. After purchase he drove it 900 plus miles back home to save on transport expenses. After getting home without any issues, he started calling us to trade dollars for positive feedback on Ebay, threatening to ruin our 100% positive feedback with his negative comment. His blackmail was not in good spirit. This entire report filed by him is untrue, uncalled for and biased. One bad apple spoils it for everybody else.
