If you have your original receipt you can do something about it. CIVIL SUIT. In almost all (if not all) US jurisdictions it is illegal to sell something as new if it indeed was previously sold to a consumer and used (unopened OEM packaging excluded.) Now, if you paid the retail price for a new item you probably can recover the difference and any statutory damages in civil court. If you paid a DISCOUNTED price you might have some trouble. It would depend on the reason for the price discount. Good luck.
