This is a good one for you. In May of 2004 star satellite sold me a system. Never mentioned anything about landlords permissions and honestly never crossed my mind. After 10 days my landlord discovered the dish and demanded me to take it down.

I had to repair the roof and the door jamb where the installer damaged the moldings all the way around the hallway door. I called Dish network they told me that its Star Satellite's problem. Star sat says, they hire independent contractors and they are responsible for damage. Ok fine come get this equipment. Your in a contract they say. I said you never got my landlords permission to install and in every rental agreement in California there is a whole paragraph about 'affixing permanently' anything to a rented property without permissions.

They can't help that I have an angry landlord. Dish network is responsible for the equipment they say, run around begins. This goes back and forth a few times and then I ask for a supervisor. Ok Dish network says they are responsible because the contract was terminated in less that 6 months. We will send you boxes they say. No boxes, 1 month goes by. I get a letter from dish network with star SAT's letter head, Please have this contract resigned, we are unable to finish setting up your account until we receive these copies of original contracts signed in the correct spaces.

I call star satellite and now if you push any button except the very last choice, you get bumped to Dish network. Talking to dish network was weird because they act as though they can help, but after they switch you to 'upper tier' they say that you need to talk to start sat. Go figure. Since I have cancelled and I am on the 'home advantage promotion' (no cancellation fee) Months go by, I'm in and out of the hospital, and since this was not

the most important thing on my mind, I let it slip.

I was never billed by dish network, except for 14 bucks which they dropped. However NOW they say that I was 'shut off' for non payment. Non payment of what? My landlord had already disconnected the cables 10 days into the contract. 49.00 was taken for deposit of the first month bill. The TV 's were on the regular antenna for months. The receiver was left in place for all this time with the phone line plugged in awaiting the "boxes". Quick comment about the receiver. Dual head type. One for the living room TV one for the bedroom. The installer puts the dish in the back of the house and the receiver in the back room. Well the one channel is IR. and the other is line of site(forget the term). SOOO the one person in the bedroom as to come out of the room and switch channels. The installer got me on that one, as while on the phone with the confirmation guy, he slipped out and left.

Misinformation...the home advantage plan that you see on TV from dish network has little to do with 2nd and 3rd party providers. When I say little I mean, the only part they use is the name. Then give it a 'special' number after the heading, that changes it to something else. Needless to say, I initialed, right where I was told to...thinking I was initialing the receiving of 2 remotes-receiver etc. My bad. Deceptive advertising to say the least. Guess who my salesman was. Jon Myers,,,some relative of the CEO, Walter Myers Star Satellite.

Oct 2004 received another copy of UN signed original contract, called them and it was less than fun.

Nov 2004 Ditto + Boxes? I asked. we no hear of no stinking boxes, they respond, we'll will send them in 3 to 7 days

January 5th 2005, no boxes 199.00 + 300.00 un authorized debit from checking. Go figure, after reading the other posts. Called bank and did the usual things you do when someone steals your rent money. I call 'J'(initial), an employee at Star. Figured out the secret code to get to 'them' through their menu. I explain that the equipment has been waiting pick up from Dish network and the contract is void for many reasons. I get A' (initial) (supervisor) OH no...blah blah. Played phone tag for a

few days, called Dish network again , boxes are on their way. UPS, I hope this time. 'A' returns my call at 8:01 am, of course I am not home, taking the kids to school. I get through to her and basically, there is nothing I can do, response. I say this is illegal and your contracts need to include a 'renters' clause, as it were. 300.00 $ is a cheap fee for such advice, I

told her. 300.00 of MY money.

January 13th No boxes. Wife calls. 300.00 + 199.00 has

been...wait for it......

DEBITED from my account again!!!!! This is where I am at now... 998.00 $stolen-bank is on it....checks are bouncing...one from the landlord who started this whole thing, on a 'point' of the lease, nothing more, but well within his rights. Rights that I was unaware of in this circumstance. If just questioned about owner/renter status by the salesman, I would have atleast called the landlord.

I will post the update for those who are interested.

EDitor's Suggestions on how to get your money back!

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

CHARGES TO YOUR CREDIT CARD

If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here.

Remember Don't let them get away with it! Make sure they make the Rip-off Report .. The more Reports filed on a Company or individual, the more likely it is that the authorities, media and attorneys will want to take action.

And good luck Let us know how you do!
