Fooled? on Ebay by Stuart Durrer Seller 011101101 ? Lets hope, not!!

Good afternoon!

I can not help it but I can not hold back something that is happening to me in this very moment... here is my story:

I was looking for a diamond ring about one carat, searched on Ebay day and night after a bargain, for a week or two, really.. call it like treasure-hunt.

Well, after a while I found one, a private person selling a solitaire diamond ring, stated 1 carat, nice quality, no grading, no certificate.

His feedback was quite allright, he usually sells everything on earth, even jewelries now and than.

We had some emailing while the auction was open, his answeres were not that satisfying (eg why he didnt get a proper diamond grading from a jeweller, he answered back that it wouldve taken two weeks but he has been told all the important characteristics of the stone). He had a return policy & I believed in his ad, I took a risk, I bid and then I won it.

I paid at once (2/febr) and waited and waited and waited ...and emailed and emailed and emailed... then after a loooong time the packet come (he posted it on 26/febr! according to Paypal-notes, and he had many excuses; his printer was out of function, he couldnt get a label with my address, two weeks later he emailed again that he got the packet sent back to him because he filled in some form wrong, after that he sent it via Paypal to me to Sweden).

As the diamond shown up, I saw immediately that it was quite little to be 1 carat. I emailed him at once about that and then I took it to 4 jewellers in Stockholm where I live, they told the same; 1/2ct stone, undoubtedly!

I tried to resolve this with him since the very beginning.

I paid for over $1000usd +taxes and duties here in Sweden.

Yes, it is a diamond, the problem is that it is a 1/2carat diamond.

I emailed him telling about it several times now, I would like to send it back to him and get ALL my money back.

He says its all right with him, but only if I send it first, so he can inspect the ring and check that I didnt swap the stone!?

I dont know how to come out of this mess?

I dont trust him at all, me sending the ring first is out of question.

I come up with a suggestion to a "solution" the other day so I can get at least some of my money back; since the stone he delivered is half of what he advertised, I suggested that he could give me a partial refund, 50% of my money back. I didnt receive an answer yet.

Now I opened a Dispute on Ebay called "Item significantly not as described" I think its called for. I tried even to open a file on Paypal, if they could help me getting my money back, but no, they can not help since I filed it 55 days after the purchase (2/febr) and their limit is 45 days, so my file is existing, but closed.

I can tell you, I almost poured my coffee in the wrong throat as we say in Sweedish when I read his theory about me swaping the diamond... On the other hand, can I prove I didnt do it? No, not really. I just got a strange feeling about that this was not the first time for him doing this to people. What am I supposed to do now? Look at it as a lesson , leave feedback so other people can be aware and see how he fooled me, or what? What should I do? What can I do from here (living in Stockholm) while he is operating in the US and active on Ebay?

Ive been member on Ebay since december last year, bought this ring 2/february, unfortunatelly not aware of the time-limits to follow as you could see. Now Ive learned a lesson, but I think it would feel very wrong if it will cost me that kind of money, thats a lot!!

If I lived in US, I would never hesitate to go to the polis since I believe its fraudulent behaviour to act like he did. Now I understand also why it took soooo long to get that ring, he was calculating with time going by (since 45 days count from my payment, not when I actually received the item). As he wrote in the Ebay file: "the 45 days are up!!"

Ive just recognised that the dispute is gone, disappeared (I had it in my computer yesterday), since the 60 days are gone...? which he was calculating with.

Now Ive started this with his name and ebay seller ID and I hope you out there learn something...

Well, now Im hanging him out, but I think in that kind of game I think he is playing he takes a great risk ... you never know who you come accross on internet, well, Im not the one giving it up that easily.

PS1: Unfortunately, he was not positive at all to resolve anything (without getting the ring back first which I couldnt agree to).

PS2: Stuart, if you read this, please, dont hesitate to take action to resolve this issue!

You have even a brilliant (!) chance to make things better from now and do the right thing. Think of your reputation! Think about it, for your best, please!

You know you received the correct item.  Everyone who has ever used Ebay Paypal knows that there are checks and balances.  If I was in the wrong Ebay and/or Paypal would of corrected any injustice.  You know you received your ring, and it was exactly as advertised.  I replied to every email you sent, in a timely fashion.  I even provided all the evidence needed to prove I completed my end of the arrangement.  It's sad how you can so easily slander someones name with no regard to the truth.  Just because you changed your mind about your purchase.  Ebay and paypal provide plenty of services to protect again fraud.

I mean who would let time expire before fileing a claim?  Maybe someone who was satisfied and then changed there mind.  Once they realized they couldn't return the time they decided to slander there sellers good name.  

Sad how quickly someone's childish rants can hurt the reputation of a good person.  I'm asking you to take the high road, remove this false claim and own up to your mistake. 


This is obviously slander, one report says the item never arrived, and another says it did but wasn't the right size.  Just shows how lying can catch up to you.  Next time tell the truth its easier!
