Well, Well, Well. I contacted SwipeAuctions aka Swipebids tonight and they supplied me with their Terms of Service. You will see under Item 18, they follow the laws of Alberta, Canada. This is good as Alberta has the "Fair Trades Act".
Here is Swipeauctions/Swipebids TOS:

I received the exact figures of the attempted charges by Swipebids (Swipe Auctions) today so I thought I should clarify the previous report.
1. $159.00
2. $495.00
3. $495.00
Total = 1149.00 not 1195.00
I also found the Swipebids/Swipeauctions company address is different depending on where you look.
At BBB, (http://www.bbb.org/edmonton/business-reviews/internet-auction-service/1524948-alberta-ltd-in-sherwood-park-ab-156691) they claim the company is located in Sherwood Park, AB. It should be noted another address at BBB is somewhere in Utah.
The Site says they are located at: 72 High Street, Haslemere, Surrey, GU27 2LA (http://www.swipeauctions.com/contact.php)
Previous reports (on this string) say the address is: 22100 East 26 Avenue

On WHOIS, I found no address on record.
So, if you are doing a chargeback, this tidbit is good to know.
VISA did contact me today to confirm the chargeback is done. I did inform them the name changed recently to Swipe Auctions and they were keenly interested in knowing this.
Even if you left your claim too long, I would still contact VISA so they have a record. I now understand they can fine, but after 2% of total sales being chargebacks, they actually pull the Merchant's account. This will best solve the problem too.
The person at Visa apparently looked at Swipebids/SwipeAuctions Refund request form and confirmed that one should not go this route. I understood this form somehow CONFIRMS your acceptance and could deny your chargeback claim. They said they are in the business to protect their customers and are fully willing to fight on our behalf. I must say, I have been very impressed with VISA.
So, the theme here is let VISA handle it and place Swipebids/SwipeAuctions in the position of defending themselves. Using VISA as your support to resolve Swipebid/Swipe Auctions charge(s) puts you in the drivers seat.

I have been researching Swipebids throughout the day as I was almost SWIPED $1195.00. This was due partly to my temporary stupidity as I am usually a real sticklier on researching anyone prior to conducting business. Swipebids (recently changed their name to Swipe Auctions...Why I am unsure) ended up on my radar simply by surfing different things. Anyway, in my case, the webpage said $1.50 to join. So, I thought no harm no foul. I imputted my credit card and went around the site to investigate it further. I pressed "Account Activity" and saw 1 $150 transaction and 2 more $495.00 transactions. As I did nothing yet, I was quite concerned. So, I logged into my bank account and saw these transactions authorized. Please remember...I did NOTHING yet ( no bidding/nothing). So, I called my Visa company right away. They started out by telling me that since I gave them my credit card number, they are authorized. I told them I authorized $1.50...not the other amounts. The next day, I saw a credit in my account. The transaction was charged back. I think this was because I was on it minutes after I noticed it. Also, I deactivated my card right away to stop any further damages.
Upon researching throughout the Internet, Swipebids is chalk full of scam allegations. What I do find intriguing is that just a few days back they changed their name to Swipe Auctions. Could this be because the chargebacks and VISA disputes bacame so numerous, they were losing money? Unsure, but if they were reputable, they would keep their name "Swipebids".
Swipeauctions is one site to proceed with caution in my opinion and from my recent experiences.
My suggestion would also be to avoid their refund forms and Customer Service chats. Simply deal with your Issuing Bank, supply them the facts, support it with the mounts of supporting documentation available throughout the internet and get a chargeback. This will also teach the merchant a lesson as if they get too many chargebacks, they receive hefty fines per chargeback. This helps get fraud out of the system.
Better yet, just go to Best Buy, Future Shop, etc and buy the item off the shelf.

When you click the link you are directed to a page that is for current member log in, or a link for "Join Now"..nowhere on that page does it say anything about a membership fee that I can notice...so lets click "join now"...
Okay..top of page is videos and info about all the news media telling how great these penny auctions are.
Scroll down..it says winning is easy. 3 steps...
1) Join and receive bid
2) Place bids on auctions
3) Win great products.
Still, I have yet to see where it states I would be charged 150 bucks to join..lets scroll down more...
"Bids raise the price and add time to the clock"
"If you're the final bidder when the clock reaches 00:00:00 YOU WIN!"
"It's that easy. Over 1000 winners daily"
Now...right off the bat I would be suspect. The bids raise the price and add time to the clock...but to win you must be the final bidder when the clock reaches 00:00:00. In a legitimate "auction", you only need to be the highest bidder when the time runs out. Bidding does not add time or raise the price. There is very little reason to trust an operation like this where the house is really in full control (aka fixed), and the house stands to make substancally more money from an item if the clock keeps adding time..and the bid price is rasied every time you bid. So although this is disclosed...it is still deceptive to a new member that they do not actually win an item when the clock reaches zero..since the very bid they put in, adds time..and the next "person" or "bot" or shiller can easily bid and add time..this can go on indefinitely..something that will never happen on a legitimate auction site such as eBay.
As well, there may be 1000 winners daily. But winners of what? Worthless bid packs? Walmart cards that cost you $10.00 to have it shipped to you?
But still, no mention that any one joining at this point will be charged 159 bucks. Scroll down more...
Media icons..and someone won a Honda Civic. More fake testimonies and a "simulation" of what the "auctions" are like.
Now scroll down to the sign up area. What is one the screen? "Win great prizes at incredible prices". Then a HUGE blue arrow pointing to the area where you start filling out personal info. In the huge blue arrow it simply states "register now, it's easy".
If you were sucked in at this point by the hype/ greed and ignorance...you will start to fill out the membership form. If you scroll down more BS testimony of other wins. There are 3 examples that state "paid $159.00 for access, won such and such a BS amount". Now although this can imply someone paid for access..and this point even if you scrolled past the registration form...it still has not stated anywhere that you are to be charged anything to join or bid.
So in order for me to investigate any further, I was going to have to fill out the form. I did this but used a made up name and email. I got to another page filled with hype and distractions and news icons and more BS testimonies.
All the way at the bottom is two columns..one on the right..and one on the left. The right column states "

..a huge influx of reports regarding swipebids and other penny auctions on this site and elsewhere.
It seems the mass media was duped as well..and in turn has perpetuated a fraud on consumers.
The news media recently did do reports on these penny auctions which gave it a sense of legitimacy.
They are nothing more then on-line gambling. Oh and that $10.00 Walmart gift card you won for $3.00..just wait until you get the shipping bill for that..you are going to be a very unhappy camper.
What the news media failed to mention..is that hardly anyone ever wins a really valuable item for pennies. They failed to mention that they do not properly disclose the $150.00 deduction they take from your account. They failed to mention the bots that are used to bid against you.
Well lets just say this penney auction certainly "swipes"...swipes consumers of their hard earned money and gives almost nothing in return. even in the rare case where someone may actually win an item at less then retail...the site made thousands and thousands of dollars from that item..do the math and add up what it cost per bid and you will see how this works out very well for them, and very bad for you.
And what does winning "bid points" really do when those bid points will be gone in seconds and it did not cost the site anything. The bid points are nothing more then virtual poker chips or tokens used to gamble away.
I hope the news media takes some responsibility and reports back to consumers what these penny auctions really are. And it would be nice if consumers were a bit more careful before submitting credit card or bank account information to a website without doing some serious research first. But I have looked at some of these sites and it seems quite obvious to me that they designed the sign up to seem like you will not be charged..but elsewhere on the site it will mention it. And it is not easy to get that refunded unless you can meet the requirements which are nearly impossible..or have the bank reverse the charges. some banks will do this..others not so much.
