I have seen the commercial and it does state "Not valid at all locations".
To the OP some Taco Bells are owned by the corporation and some are franchises which are owned privately. Franchise locations typically do not have to participate in the promos or even honor printed coupons. That is most likely the case here.
However if they are unsanitary you should report them to your local health department.

I haven't seen this particular commercial because I watch very little television but when a chain restaurant advertises a promotional price, they include some sort of fine print on the bottom of the screen that says "participating locations only" or some similar language. That gives franchise owners the ability to opt out if they need to.
Did this commercial say anything like that?
