On 7-21-2009, I got this payment book in the mail, I then called and talked with a Jeanette. I told her that, I just got a payment book in the mail and you all mail on 7-15-2009 and my First payment is due on the 15th of July. I told her what's going on with my school and that, I have not taken my test yet because they wanted payment from me first. The last time, I talked with Sherry at my school "Salon Professional Academy-Inverness" was that they did not approved me and, I needed to come up with some money for them. (Not at all did anyone call me). So, anyways, Jeanette said that she was going to talk with her manager and get back with me. No call from her or a manager. I told her to tell who ever that, I needed more time to pay since, I have not taken my State test yet. I wanted them to put off my first payment on Sept. 25, 2009. Also Jeanette said that there company does not report to the "Consumer Credit Agencies" unless you are late. Which come to fine out that is a lie... Again, I called on 8-6-2009 I asked for Jeanette and she told me that she has not heard anything for her manager. So she said that she put in a new request again. And that someone would call me back. No call. I then called again on 8-7-2009 and said that, I have waited to talk with a manager and no phone call yet. So, Jeanette put me on hold and talk with her manager and then came back to me and said that there is nothing she could do. And she could not change anything and, I needed to pay. Then Jeanette said, that, I signed for a contract with them, I said no, I did not. I want to see this contract that, I signed again she put me on a very long hold and came back and said, that, I need to call you on Monday 8-10-2009 and she will find the contract and fax it to me. So, again Monday 8-10-2009 came and gone with NO PHONE call. Then, I'm really starting to get mad. I called on 8-11-2009 and asked for Jeanette and she was out to lunch. I then talked with a Nancy and told her what is going on and, I need to talk with your manager. She said, I had to leave a message and the manager would get back with me. I said ya right, I'm sure they will. So, I waiting all day long and still no phone call.

Then Dorene Steven the "manager" got on the phone and, I told her what, I told Jeanette for weeks now. I can't pay the payment of $324.75 on July 15th nor can, I pay the payment on Aug 15th $324.75. I told her that, I NEVER signed a contract with you people "TFC Credit Corporation" nor did, I ever get a phone call from you or from " Salon Professional Academy-Inverness" saying that, I will have my first payment due on the day you guys mailed out my payment book which is 7-15-2009. This Dorene Steven really didn't seems to care, all she wanted to do is fright with me. She didn't care to hear what, I had to say. BUT, I did talk over her and said, that, I didn't sign a contract and she said yes you did on July 2008 with "Salon Professional Academy'. I said, yes, I sign a contract with Salon Professional Academy AND NOT WITH YOU " TFC CREDIT CORPORATION". Then she with on in saying that, I signed with Salon professional and this is the same contract. I then said no it's not. How did, I no over a year later that, I would get you guys. I told her that, I needed for you to re-send me a new payment book starting with the new date of Sept 25th, 2009. This will gave me time to take my State test. I told her, I already have a job and that, I'm not frighting with her about the amount. I just need some time to take my test and start my new job and get on my feet. I don't want to have a 30 days on my credit. and NOBODY from your company nor from Salon Professional told me that, I would have this payment due 7 days after, I got my payment book in the mail.This payment book was mailed off the same day as my payment was due. This is not right, I told her. She really didn't care what, I really had to say. I told her that my mom had a attorney friend and he also said this is not right. I had to sign a contract from " TFC Credit Corporation and not just from "Salon Profressional" when, I started my school. I gone back and look into my contract with my school and not at all did my contract say that, I will be ohing money to "TFC Credit Corporation". Again, I don't have a problem with paying them, I just need time to take my State Broad Test and get my job and start making money. But, Then Mrs. mean lady went on in saying "Dorene Steven that she will make note in my file that, I will pay on Sept 25, 2009. I said he you not hear from, I have been talking about for the last half and hour. She said yes, I said ya right. So, I then said, OK you will send me out a NEW PAYMENT BOOK with my NEW PAYMENT DATE starting on Sept 25, 2009. She said no, I'm only making note that you will be making your payment on Sept 25th. Then, I said well then, I will be 30 days late on July 15th and Aug 15th and she said yes, I will be, This is the best she can do for me.

I said great then you will be hearing from my mothers attorney because this is not right. I didn't sign for anything from your company saying that my first payment would be on July 15, 2009 NOR even knowing that, I had you guys as my Financial Company. Someone should of let me know what was going on. Called me. Now, my Credit will be all messed up because of these people "TFC Credit Corporation". They are a rip off. Make sure you have everything in writing. I never signed for anything and, I'm in a very bad way. If anybody out there can help me. Please let me no..

Robert is exactly right on this. I've got no reason to disbelieve your statement that the manager was rude and nasty, but she was probably trying to explain a little something about contract law to you as you were talking over her.

The right to receive the benefits of a contract is an asset and can be transferred just like any other asset, unless the language of the contract specifically forbids it. The only restriction is that the material terms of the agreement can't be modified unilaterally.

In fact, I would go so far as to say that MOST loan agreements are transferred. It's the rule, and not the exception, where one company markets a loan product and executes the contract and then "sells" the debt to another company.

Company "A" is basically in it for a commission, or originates the loan to facilitate a purchase, and doesn't want to deal with the liability aspect of the loan or sit around and wait for payments. Company "B" isn't interested in selling loans or products, and is willing to take on the liablity and delay in return for the interest.

So yup, in the future, don't be so surprised when you end up making your loan payments to a different company than the one you signed with. You have every right to validate that you're paying the right people, and you most certainly still have your rights under the original agreeement, but your duties are now owed to someone else.
