I sought the services of this attorney to fight a possible eviction notice that I received from my partner of 15 years. My ex-partner and I resolved the matter before the eviction date. I had given this attorney, Robert English, a $1000 in anticipation of needing his services. When I called him to let him know that the matter had been resolved and that I would not be proceeding forward with fighting the eviction notice and that I would offer to pay him a few hundred dollars for the initial consultation (which was advertised as free) he congratulated me on resolving the matter but he would not be returning any of my money since his retainer was non-refundable. He claimed that he did some research - I highly doubt it. I thought my offer of a few hundred dollars was more than reasonable since he did NOTHING for my money!

The report is inaccurate. This client came in to retain my services on an unusual eviction case involving an unofficial domestic partnership arrangement. I quoted a $1000 flat fee for handing any aspects of this matter. It was not a retainer, but a flat fee for services. The client wished me to be prepared to respond at a moment's notice. I cannot be prepared in that manner without research and preparation. On his behalf, I reviewed numerous documents and material that was provided and conducted specific legal research into his unique situation. The initial 30 minute consultation is free as indicated, but the client went well beyond the initial free consultation timewise. Normally, my billing rate for hourly matters is $300, so even if the matter had been a retainer rather than a flat fee, it would have been exhausted in 3 hours and 20 minutes. Consultation, research, and document review was well beyond that amount of time. I would note that this individual did not make a state bar complaint or attempt any form of resolution or fee arbitration but chose solely to malign my reputation without cause.
