My wife wanted to go check out the new Rush Fitness center because it was open 24/7. We talked to a "Manager", really a sales manager that will be transferred to another location by the time you have questions, who told us we could get a 50% discount if we signed up for three years. We were planning on buying a new house so I asked him what we needed to do to cancel if we moved. He told us we would only have to pay a $99.00 cancellation fee if we moved and wanted to cancel.

We told him we wanted to think about it and read the contract before we signed. He said he was in a hurry and had to leave and the 50% discount ended that day. He laughed and told us don't worry no one reads the contract, it only has the stuff I told you in legalese anyway. Just sign it and get your discount. If there is a problem you can just cancel. Little did we know that is their standard SCAM line.

We used the Rush for about a year with only minor problems, like child care not being there when advertised. Then we bought a house and moved as we had told the sale manager we would do. That's when the big problems began. I went to the Hixson Rush and gave them a letter of cancellation. They said they couldn't receive them there and gave the FAX number for the corporate office. I called to confirm that corporate had receive it. They confirmed they had received it, I explained we had moved and they said they would take care of it.

The next month they continued to charge the normal fee of $89 to my wife's debit card. We though that is was just the cancellation fee they had mentioned or they just hadn't gotten it processed in time. The second month the charges continued. So I took a copy of the cancellation letter to the local Rush branch and FAXed it again to corporate. I called corporate and they said they would take care of it, they didn't. The charges continued for 2 more months, until the debit card expired.

When they could no longer automatically charge us, the collections calls began. Many calls and several months later, I finally got to talk with a Sr. Manager at Rush corporate that informed me that we would have to send proof of residence that we had moved more than 100 miles away (That is not in the contract anywhere) from all Rush facilities and pay all fees and dues to current before we could cancel. I explained that while I didn't know how far it was to the nearest rush facility, those were not the conditions explained to us at signing or the contract and we had already paid $320.00 since we had moved and started trying to cancel. She asked me to FAX her a utility bill and she would take care of it, so I did. I tried to call to confirm she had receive it and taken care of the cancellation but only got voice mail.

Over the year since, every month or two we receive calls from a Manager or collection agent at Rush. They ask us to pay, we explain the situation, they apologize and say "we promise we will take care of it", they don't and we get a call next month. We even paid the $100 cancellation fee again and were promised it was over.

They have now turn it over to a collection agency that is demanding over $1,300 from my wife and I. That's $1,620 they are or have extorted from us.

Rush also tries to keep you paying even if your contract is over. My wife's co-worker was a member for 3 and a half years and tried to cancel after the end of her contract and she was told she had to pay a $99 fee (I call it a bribe) to cancel. She doesn't even have a contract! Her 36 months are up!

These guys are slipperier than bear grease, and harder to get rid of than Kudzu. You southerners know what I mean. ;)

I want to file a suit against Rush to keep other people from going through what my wife and I have with these guys. Please someone contact me about getting a class action suit going against these guys. I need the help of an attorney to make these guys go away.

After seeing all the people the Rush have ripped off, I really think we should all get together and file a law suit. I just filed my own report. In a nut shell, I joined in April 2009, after my husband had left me for another woman and I was six months pregnant with two other children. They said they were giving me this super fantastic deal, if I could pay in full 3 payments of $500 over the next three months. It was only when the money started coming out of my checking account that I saw they were taking an additional $58 a month. At no time did the sales man mention a monthly payment. $1500 was supposed to have the three year contract paid in full. The $1500 and $58 a month total $100 a month! That is ridiculous! I felt like such a sucker. But since I signed the contract, I paid for three years. After the last payment I closed the checking account. I was then sent a bill from a collection agency for $73. I paid this too. Then I was sent a bill for $154. I sent the required registered letter, immediately cancelling any month to month contract that I did not sign up for. I can't afford all this and the Rush is going to mess up my good credit. I am so upset, I don't know what to do. [email protected]
