If I have read your report properly, you basically hired a rental manager to manage the property for you, he is not giving you the money he collected. is that accurate ? I have ran into the same problem with Brian Mayo from Indianapolis. He took over a company called "Life Homes" that I had a contract with to manage my property with for 2 years. Brian has failed to turn over 5 months of rent. now he is trying to get out of it by filing bankruptcy. I talked to an investigation company about this (Brian never contacted me originally, I had to hunt him down after he took over the company) the investigation company said that anyone that collects rent on your behalf and then not giving you the money, is considered as stealing the money. it is not a matter of a lawsuit that he owes you something (like an unpaid bill for services) its money that was supposed to be yours to begin with and he serves as nothing more than the courier. Since the money is yours, him keeping it is theft. File a police report. That's what I am doing. The investigation company said they will do it for me.
