My wife and I entered into a contract with Tom Strait of Strait Investing Group, Inc. for the lease of our home beginning in October 2003. Tom found a sublessor who he began leasing the property in that same month. He made the October and November 2003 payments.

In early December (around the 12th or 13th) Tom told me that he was having financial difficulty and said that he couldn't make the full months payment for December. He promised to pay us a partial payment later in the month (December) and then to make a full or partial payment in January. We said that we would allow him the time requested. However, at the end of December there was still no payment, partial or otherwise.

January came and went with no payment either despite statements from Tom that he was honestly working hard to get everything caught up and that he would make a partial payment soon.

In February we made it clear that we would have to have the full amount of February's rent by the first of the month. February's payment was received although $13 short.

In the first week of March, Tom again promised to have March's payment by the 10th. Since that conversation we have not received any money from Strait Investing nor have we been able to contact him, even by certified mail. No one has ever been at his business office the several times that I have visited during normal working hours. I received no return calls to the numerous messages that I left on his work and mobile phone answering services, and his home phone number was disconnected as well.

We have filed a lawsuit in small claims court to receive the back rent owed to us. Since experiencing this problem we have found the report of another party that was ripped-off by Strait Investing Group here on Rip-off.com by conducting an internet search. We are hoping that by writing this complaint we may be able to prevent Strait Investing Group from taking advantage of someone else.

If I have read your report properly, you basically hired a rental manager to manage the property for you, he is not giving you the money he collected. is that accurate ? I have ran into the same problem with Brian Mayo from Indianapolis. He took over a company called "Life Homes" that I had a contract with to manage my property with for 2 years. Brian has failed to turn over 5 months of rent. now he is trying to get out of it by filing bankruptcy. I talked to an investigation company about this (Brian never contacted me originally, I had to hunt him down after he took over the company) the investigation company said that anyone that collects rent on your behalf and then not giving you the money, is considered as stealing the money. it is not a matter of a lawsuit that he owes you something (like an unpaid bill for services) its money that was supposed to be yours to begin with and he serves as nothing more than the courier. Since the money is yours, him keeping it is theft. File a police report. That's what I am doing. The investigation company said they will do it for me.
