On October 4th 2012, my wife took her 2007 Hyundai Veracruz into Tires Plus Total Car Care in Oviedo, FL for an oil change.  Now to be honest they have serviced this car in the past flawlessly.  We have purchased tires from them and they have fixed a suspension issues.  So what harm could there possibly be with them doing a simple oil change?  

Apparently a lot.  When they replaced the oil cartridge, that is right cartridge, they use one based upon a cross reference lookup.  Unfortunately the cross reference cartridge did not match what was needed to properly provide adequate oil pressure in the system.  

My wife picked up the car, was leaving when she noticed that the low oil light was on as well as the check engine.  She immediately turned around and returned to the shop.  They then spend 2 or more hours trying to figure out why the sensors were reporting low oil, when it was full and the check engine light was on.  They pulled the OBD codes but were unable to decipher them, so they total her to take it to the Dealer.

At the dealer, the mechanics pulled the oil cartridge and notice that the part was the wrong one immediately because it lack the need shoulder and gaskets to properly seal the oil system.  With that info and the OBD codes then check the Oil control valves and found both of them damaged from the low oil pressure resulting from the improper filter cartridge being used.

I filed a claim with Tires Plus Corporate, got a claim number (94662).  They sent out a third party claims inspector to the dealership.  He took photos of both the filter that Tires Plus installed and the correct filter and it was clear that the Tires Plus used the wrong filter.  He even commented to the service manager that he sees this all the time.

Presented with the clear and convincing information, Tires Plus went silent.  I received a few emails from Mr. Juan Mendoza saying, 'They stand by the claim they did not use the wrong filter.'  But pictures tell a better story.

As of this point I am filing small claims to recover the cost of fixing their mistake and associate costs suffered.  But Tires Plus Total Car Care refuses to provide their registered agent for serving of the court papers.

After looking at the photos that your claims agent took, do you still deny that the wrong filter was used?  I also have a copy of the Hyundai TSB clearly stating that the use of aftermarket filters may lead to pressure variations within the engine.  Which this is clearly the case.  TSB number is "12-EM-006" and is date September 2012.  Your claims agent was also provide a copy of this TSB.
