These fools have been calling my folks and threatening them saying I own all this money at 333% finance rate for two loans that was not authorized by me. I made the mistake and applied online for one check loan, and all of a sudden my bank account was being deposited and withdrawn and thrown into over 1000 dollars in the whole cus of every one taking money out of my bank account.

Tri Financial called me I talked to them told them i dodn't have the money and neither did my friends or family. They cussed at me asked me if I had any firearms or dogs I told them it was none of their business, the supervisor got mad and hung up the phone on me saying the cops were coming for me and this that and the other thing.

For the OP: You say that your account was being deposited and withdrawn. The deposits would indicate that you did accept the loan, they put the money into your account and then started debiting per the agreement. For Reactor: You're correct up to a point. The FDCPA does not apply to the original debtor, only to collection agencies. However, these companies should understand that they would get better results by working things out instead of threatening their customers. For Stacy: Oh no, another company you work for. How do you keep all the tax information correct??? LOL

If everything you've said here is accurate, you should know that what these people are doing is totally and completely illegal. They are not allowed to swear at you nor be abusive in any fashion. They are not allowed to call after or before certain times. They are NOT allowed to threaten your person or property with threats of seizure of assets nor imply that they work in ANY capacity for law enforcement. They are NOT allowed to call friends or family and demand payment from them, nor discuss your personal financial business with them. These people are nothing more than "debt terrorists". The whole "do you have firearms or a dog" thing is a *veiled threat* that they are intending to enter your property and seize assets. This too, is very illegal, this and all the above, under the Fair Debt Collection Act. Google it. It's your friend. IANAL, but this is usually recommended for people who are going through this: Next time a "rep" calls, get full surface mailing information for the company, including the name of the receptionist who receives/is responsible for the mail. Get the agent's name. If they refuse to give this information, tell them they are in violation of the Fair Debt Collection Act, and the call cannot proceed without this information. Next, prepare and send a "Cease and Desist letter" to the address, explaining that you do not have the money and tell them to stop calling or having any contact with you. You can Google these too, select one that suits your situation best and adjust as necessary. Send it via REGISTERED MAIL so that it is required to be signed for and you get proof of acceptance. This way they can't say in court that they didn't get your demand for them to cease harassing and calling you. Any calls you get thereafter can be viewed as harassment under the law and are actionable in court for each instance. Do you have any recordings of the abusive calls? You may need to inform a caller that he/she is being recorded (check local laws), but that's OK too, since you'll doubtless have a computer file in their system. A flag on the file saying "records phone conversations" can oftentimes put some of these jokers in check. If you follow the law in notifying them of recording and they speak anyway, that's giving you clearance to offer that conversation as evidence to whatever body wants to investigate. Speaking of... Attorney General. Get on that and be as concise and cear about all the details. Lodge a complaint. If you incurred a debt, you are liable for the debt. However, there is absolutely no need for abusive action or words from the creditor. Many of them hope the average person is ignorant of the Fair Debt Collection Act, because if they aren't, it takes a HUGE chunk out of the collectors arsenal of dirty tricks; namely abuse, veiled threat and other types of intimidating behavior. Don't be a victim and don't allow yourself to be victimized. Know the law! Arm yourself with it and don't be afraid to stand your ground. If you're so inclined, go to YouTube and look for a channel called "War on Debt"... they have excellent info on how these strongarm collectors work, but also WHY they act in such an inhumane manner (Hint: It has to do with MONEY) Good luck
