Please don't take this the wrong way but you really don't have any right to keep a car that you are behind payments on. Banks are not under any obligation to let you keep a car and work with you if you are behind in payments. Some will, but some won't. It all depends on your situation, and this is your 2nd time. You may have a remote chance if you did record them that said they would move them to the end of the loan. But if I read this right you would then have about 6 months payments "moved". When they move(defer) payments to the end of the loan they DO NOT extend the loan. So you will have a huge last payment to make. If you don't pay that payment they can still Repo the car and they won't defer your payments any more because you are already at the end of the loan. This is something you need to take into consideration. Now if they are "looking for the car", and can't find it. They can get a court order to force you to hand over the car. That is they will come to your house with a your local law enforcement officer and if you do not give the car to them you will be arrested for violation of a court order. It's not a nice option, but when you got the loan the company holds security in the car and have a legal right to take it back if you don't pay.

I have an auto loan thru Triad. They plan to repo as soon as they find the car. I was cut back to part time for 2.5 months at work. I'm $1,120 +/- some change. I called to negociate repayment of the past due. Triad refused to work with me. However, "julie" told me that if I could pay $300 by that day of our call, they would commute the rest of the pass dues to the end of the loan. Hmmmm, I told her their rep in 12/2006 said the same thing. I had been laid off, was 3 months behind on car payments. The man said if I made 2 payments, he would commute the rest of the past due to the end of the loan. So I paid the 2 payments. 30 days later, I received a letter stating I was behind one month. I called Triad. The rep said they don't due things like commute payments to the end of the loan. I called and talked with several of Triad's reps and most of them came up with the same story. The same man mentioned above said that "it has to go through an application process, the app goes before a board, there is no guarantee that the app will be accepted. Then he mentioned, "oh ya, we have a quota and it has already been met this month, so when can you make that payment??" Guess what "julie" did - she put me on hold very quickly, and then came back with the same harrassing comments about paying......although not willing to accept what I had to offer in the time frame I could provide it in. What the He**!!! So now, any moment, Triad is looking for their car. What are my rights and what can I do!?!?!? Lose my job because I can't get there?? I live in a town without a public transporation system????? I, too, live in Idaho. I did record the last conversation with a Triad rep, a man. He also gave me the same spiel about making one payment, and then the rest would be commuted to the end of the loan. He gave a big pause when I related the same info above.... So California attorney......what can I do? My family and I depend on this car. Thanks for any help you have to offer.

I paid the loan in April of 2007, I thought I paid it off and called them to get the title and was told I still owned 900.00. I have to pay it before they can get me the title. I ask them why do I still owe. They told me it was late charges and Interest piled on. I gave them 1200.00 in April thinking I paid it off.Since the car payment was only 408.00 and the 1200 was three months worth. I had to call my dad to give them the 900. I personally went to the office and what I figured it was only a office that has a receptionist anwering phones. No one to talk to, I had to use the office phone and was talking to someone in Texas. I gave the receptionist my money order and got my title in 10 days. They are a pain to deal with. Good luck on your situation. I wish you all the best. I now have a new car and it is financied thru toyota financial. great company

Are they still trying to collect more than what was negotiated for? Since you are lucky enough to live in a "one-party" state - you should be recording all of the conversations with Triad. I'm an attorney in California. Update your post if anything else happens. Julie
