After having to send an email to the president of the company at their corporate offices, I finally received a call from a snooty lady. I proved to her that was not my account.
Then, found that was over 13 year old charge off against my son (who was barely 18 at time of loan). She tried to pump me on where to find son. I explained that there is a statute of limitations on collection of charged off accounts and that they were guilty of predatory phishing to illegally collect written off accounts.
I also explained that were trying to collect on account that was not only too old, but for a defunct predatory car lending outfit that went belly up in 2002.
Still refused to listen, so I told her that I would just file lawsuit if they pursue it. Below is my follow up letter to the president.
Sir,
Thank you for having someone respond to my earlier email to you. Rebecca, the account rep that called back, was both cordial and resourceful. In fact, if I didn't have a very good working knowledge of lending laws and a very good attorney, I might have been scared out of my wits. However, that is not the case.
I have proven to her that the debt is not mine. In fact it WAS a debt incurred by my son when he had just turned 18 and that was charged off over 12 years ago. According to Florida law, the statute of limitations to try to resurrect this supposed debt has long past. Also, the supposed aggrieved company went belly up in 2002 due to their predatory lending practices.
So, I must say that if any attempt is made to contact either myself or my son in the future concerning this matter, you will be litigated against for harassment.
