On or around 10/01/2008, I saw an ad in a chiropractic journal and called Trinity Medical Solutions , leaving a message for someone to contact me because, I had a used Myovision 8000 that I wanted to sell. Within a couple days, Matt Carns called me and got my contact information and said that he would fax me a quote, bill of sale, & document to fill out and sign and instructed me to mail it back to him so that he could sign it. I asked how much my Myovision 8000 was worth and he told me $1500. He further said that he would not pay me until he received my device and got it checked out to make sure it was working in good condition. I contacted Matt Carns via phone and email and told him that I never got the documents. He told me that he just fired all his staff and he has new staff and they haven't been trained yet and that he would fax the document himself.

On or around October 27, 2008, I told him that I still hadn't received the documents and would mail out my device as soon as he sent me the documents. He told me that he would send it soon but he needed me to overnight my Myovision 8000 because he needed to include it in a deal that he was working on with a Dr. in Florida. He said that he would reimburse me for the shipping charges and to save the receipt. I over-nighted my device on 10/29/2009 via UPS.

Over the next several months, I communicated with Matt Carns via email and never got paid the $1500 plus shipping charges of $189.77.

At some point in November of 2008, Matt Carns shipped my device to Myovision so that they could transfer ownership and add a USB port.

Over the next 60 days, I contacted Matt Carns numerous times via email and telephone for payment status but he kept telling me that he hadn't been paid yet by the other doctorand he would pay me soon.

On 01/30/09: I called and spoke to a representative at Myovisionand she said that my unit was indeed sold to another doctor and ownership was transferred in Dec. 2008. On

01/13/2009: I turned this mess over to my Office Manager, Jennifer, who documented several telephone conversations with Matt Carns and messages she left for him.

On 01/21/09, Jennifer left him a message stating the she expected a return call and would continue calling until she got one. He returned her call at 7:15 that evening. He told her he wanted to make a partial payment of $750.00 on 01/23/09. Jennifer told him that the only way we would agree to that would be if she typed up an agreement for his signature, acknowledging that it was only a partial payment and stating when the remainder would be paid. She also questioned him about whether or not he had sold the machine. He evaded the question, by stating No one is buying anything right now. He agreed to her terms. Jennifer typed up the agreement with a place for his signature and that of a Notary Public for the State of Colorado. She faxed him the agreement immediately.

On 01/30/09, when Matt Carns had not returned the agreement or called, she called him again. This time he claimed that he did not receive the agreement and asked that she fax it again. She attempted to fax it again on 4 different days, making Matt Carns aware each time that it would not go through. On 02/13/09, Jennifer called Matt Carns again and got him to verbally agree to pay the entire balance by certified check or money order within 10 business days, or she would be contacting the Better Business Bureau and the Georgia Chiropractic Association. Matt Carns said that was fair enough and he would send the money. He further asked for a reminder call on 02/19/09which she did.

The funds were to be delivered by 03/03/09 by 5:00 pm, via certified check or money order. Today is 03/16/09 and no surprise, we have not been paid nor have we received any contact from Matt Carns.

4/01/2009: I would like to make an update to my past blog on Matt Carns. Matt Carns called today and we had a long conversation. He has agreed to pay me the $1700 that he owes and I agreed to help by accepting payment over the next two months. Matt Carns was polite, professional and appologetic. I was very appreciative that he called and worked out the payment plan. I do and I will recommend Matt Carns to other doctors. Dr. KVM

A typical con man. This case has all the hallmarks of a typical con job. It's gonna be a b***h to prove anything with the little evidence that you DO have. There's not alot you can do about it now. You shouldn't have sent the piece of equipment off until you received the paperwork so you at least HAD some type of proof to document your charges/claims. I'd even doubt the value that he quoted you. It might have been worth much more. I wouldn't believe one word about that office staff BS. What you should have done is gotten on the phone to Myovision and raised hell with them. They probably got conned by carns as well and he probably owes them money also. You should have told them you were the lawful owner of the piece of equipment and to not allow it out of their hands. DON'T FAX JACK!!!! Send him EVERYTHING BY MAIL RETURN RECEIPT RQUESTED, so he has to sign for it which he probably won't. VERBAL DOESN'T MEAN JACK EITHER. The fbi has more important thing to screw with then a piddlin' $1,500 piece of medical equipment, when there's billons of dollars going up in smoke. File a theft report with your local police department. Stay ontop of the local department AND local district attorney to prosecute. Have them swear out a theft warrant for his a*s. That'll get his attention. Find out WHO bought your equipment if you can. Notify them that they received STOLEN equipment. Make life hot for this SOB. That's the ONLY thing they understand.
