I have had TXU for over 13 years and yes if you pay late on several occassions they will ask for a deposit. They are providing a service not a pay as you go. I was in the same situation, had to pay the deposit and have never been late since. You can seek other providers but they do the same thing. Reliant is one.

when i asked them why, they said it was because i was a late pay. my service was never disconnected, and i paid after the date was due but never went over my late period
- What part of the concept of a "Due Date" don't you understand? When you pay after the due date you are late. It appears that they didn't like your reputation of paying late and as a result required you to pay a higher deposit.
Of course if you think you are in the right then you need to contact the Public Utility Commission of Texas as they are the company that regulates them. You can get to them through www.puc.texas.gov
