Frank, These are junk debt buyers who most likely paid a penny or less on the dollar for this old debt. Keep in mind that when you go to court, it will be you who determines if they win or not. DENY EVERYTHING! And stay off the phone! Do not even acknowledge the old debt as it is only relevent for determining SOL. The original creditor is otherwise totally out of the picture. Immediately get a lawyer if you do not understand all of the ins and outs here. You can screw yourself real easy without even realizing it. They must prove you owe THEM the money. They must prove they own or have right to collect the debt. They must prove it is within the SOL for collections. However, they only have to prove these things if YOU challenge them. The court will not do it for you. This item is most likely past the legal of statute of limitations making the lawsuit frivolous. The SOL in TX is 4 years from date of charge off. Good luck.
