As a loan officer for over 4 years, I can only tell you that the loan officer is required to give you a Good Faith Estimate. This lists ALL settlement fees and the application you signed also shows all information, which would have included your credit cards being paid off. Any of there fees that are disclosed can not increase without being redisclosed. The interest rate is also disclosed on the final application at closing that you signed called the "Truth and Lending" document. At the closing, the attorney is required to go over all information and asks you if you understand or have any questions. The interest rate is ALWAYS mentioned. If nothing was mentioned about your credit cards being paid off, why didn't you ask. All that information would have been disclosed on your final HUD. Part of the reason our industry is in the current chaos, is because borrowers like you did NOT take responsibility for understanding documents before you sign them. I was taught as a child to NEVER sign anything unless i fully understand what it is i'm signing. Please do NOT blame either this mortgage company or loan officer. It's possible the loan officer did not include the credit card debt but as a borrower, you should have noticed these liabilities were NOT included on either the final application you signed at closing or on the final HUD as well as your new total payment and interest rate. All of this would have been mentioned by the closing attorney. You are NOT required to go through with any deal, even if you are sitting at the closing.

Response to Vandykes rebuttal!! If a three minute conversation with me over the phone constitutes an investigation, then Vandyke did a good job. Otherwise, this is just more lip service from a company attempting to cover their a*s! Vandykes investigation, as well as keeping their agreement with me is BS! "Dan Chandler is a liar"! If I had the resourses to hire a lawyer and take them to court, I would have, but when your dealing with Liars and cheats theres no guarentee of success! I'm like most americans living paycheck to paycheck, I can't afford the expence if I lose! They know that, and prey on people like me! Vandyke Mortgage owes me $8000.00 dollars, thats the amount Dan Chandler ripped me off for, until its paid, I will continue to bring their unprofessional, and unfair practices to light to as many people as I can!! you got away with it this time, my hope is that this report will prevent anyone else from being cheated by you! I STRONGLY RE-ASSURT, "BEWARE OF VANDYKE MORTGAGE" and one Dan Chandler! Their after nothing more than to fill their pockets with your money, having no concern for you or your welfare! No wonder the Mortgage industry is in the shape its in! With companies like Vandyke, its not going to get any better! They and companies like them are why thousands of people are facing forclosure!!

While we at VanDyk Mortgage Corporation appreciate the value of forums such as this, we do take issue with the report posted here. We have investigated this particular matter and have found no evidence of wrongdoing on the part of VanDyk Mortgage Corporation. If such wrongdoing had occurred, the poster of this report would likely resort to a more formal and effective means of remedying the situation. To date, no formal complaints have been filed concerning this matter.

7/9/2007 After being encouraged by the prompt contact by one senior VP of Vandyke mortgage by the name of Charlie Something, "NOTHING" has happenned, I was ask to give him 1 to 2 weeks to investigate further and he would recontact me with a plan to correct this situation, its been almost 5 weeks and I've heard NOTHING! At this point I will have to refer back to my original report, "BEWARE OF VANDYKE MORTGAGE CORPORATION, And one DAN CHANDLER!! I will seek other places both locally, and abroad to file reports about Vandyke Mortgage. "Very Unprofessional"

Upon being promply contacted by a senior vice president of Vandyke Mortgage corporation, after learning of what had happenned, I feel confident that the problem I've experienced in this refinance is NOT with Vandyke Mortgage, but rather, with a certain individual! Measures are being taken to correct this! I will file an additional update once this is concluded!
