Small business Unlimited is not Unlimited

Purchased 6 vonage lines for the small business I work for because the offered unlimited calling. Worked great for 2 months then all of the sudden they changed my rate plan and charged me a new activation fee.

They changed the plans of all of my phones to the Call Center rate-plan at a rate of $99.99/month for 5000 outgoing minutes per line with Overage calls will be billed at $0.025/minute.

I did not authorize this change and was furious that I was just charged $660 dollars for no reason.

Vonage sends me an email saying that call usage is in violation of their terms of service. We placed thousands of calls on these devices over the two months we had them under the assumption that the $50/month per line fee was for UNLIMITED USA/CANADA calling. It seems in Vonages opinion after you make 5000 calls per month on a line you are using too much and according to their terms of service using the phone too much for what a small business should. Why do they say its unlimited but when you use too much change your plan to a plan that is not even advertised. There is nothing in their terms of service that puts restrictions on the number of calls minutes you use.

2.3 Small Business and Vonage Office Anywhere Use of Service and Device. If you subscribe to Vonage's Small Business services or Vonage Office Anywhere Plan, the Service and Device are provided to you as a small business user or business traveler. You shall not resell or transfer the Service or the Device to another party without our prior written consent. You are prohibited from using the Service or the Device for auto-dialing, continuous or extensive call forwarding, telemarketing (including, without limitation, charitable or political solicitation or polling), fax or voicemail broadcasting or fax or voicemail blasting. We reserve the right to immediately disconnect or modify your Service if we determine, in our sole and absolute discretion, that your use of the Service or the Device is, or at any time was, inconsistent with normal small business or business travel usage patterns, or that you have at any time used the Service or the Device for any of the aforementioned or similar activities.

So in all essence this company is running a scam and using deceptive advertising to sell their product. Buyer beware UNLIMITED VONAGE IS NOT UNLIMITED.

Telemarketing is not an allowed use of that plan

Their contract does seem to be worded so that Vonage can at any time change the plan. Unlimited apparently doesn't mean unlimited. I wonder how a small business is supposed to operate in a "normal" fashion without making any sales calls.
