On Sunday, 12-21-08, I contacted Darwin Beaty at Wachovia Loss Management (Card Services) (704) 590-9738, as Wachovia Branches, Business Account Services, Disputes and Loss Management were currently closed. The purpose of my call was to dispute Two (2) Automated Debits from my business account (XXXXXXX) that occurred on Friday, 12-19-08 from GOOGLE ADWORDS., $634.38/ $93.61 and prohibit any future debits from this company. Mr. Beaty made a evidentiary annotation to the Wachovia Computer System, time stamped, with remarks Customer requests dispute of Automated Debits.

Worried additional unauthorized and fraudulent debits would attempt to clear on Monday, I asked Mr. Beaty if I could place a freeze on the account and/or stop payment any future Automated ACH Debits to my account from GOOGLE ADWORDS. Mr. Beaty stated he could not freeze or limit the account in any way nor could he stop payment on any future ACH and that I should contact Business Services when they re-open, on Monday, 12-22-08. There was nothing he could do. This is the first verbal dispute made; made within 24 business/banking hours of the first 2 transactions.

On Monday, 12-22-08, (2) more unauthorized ACH Debits had cleared my account from GOOGLE ADWORDS. Wachovia Business Services was contacted again Monday, where I once again attempted to dispute and reverse the now (4) unauthorized ACH debits to my account. Customer Rep (Female) transferred to another Rep at Loss Management (Female) who indicated that transactions showing as Processing had in fact already cleared, and I would need to fill out a dispute form that she offered to send me by snail mail. She could not email it. She stated it would be 5 business days when the funds would be returned to me. This is the second verbal dispute made; made within 12 business/banking hours of the second two transactions.

Dispute documentation was downloaded off the Internet. It was then faxed and received at Wachovia , Tuesday, 12-23-08 at 10:18a, per Wachovia records, indicating that Wachovia did receive the signed documentation within 48 hours of the (2) Two 12-22-08 unauthorized transactions $3490.92, $799.55 and failed to act in a timely manner. Regardless, verbal disputes were made well within 24 hours.

Wachovia denied the return of all 4 transactions stating their policy is 24 hours to dispute this type of ACH, this per Felicia White. This equates to a total loss of $5,018.46 plus overdraft charges. This left the account seriously negative Furthermore, on the day of denial, Wachovia took money out of another one of my account to cover the overdrawn account without any authorization.

that they are authorized automated debits and the consumer wants to stop paying them so instead of going after google and cancelling, they are blaming the bank for paying what is submitted to them as they must do by law.

Protections against unauth charges differ

Just an FYI, business checking accounts have lesser protections against unauthorized charges than does a consumer account. The federal regulations allow for disputing electronic transactions on a consumer account for up to 60 days after the actual transaction. But for a business account there is no such provision in the federal code. The thought being businesses are more sophisticated and should know more about what they getting into when they give someone their checking account information than does an ill informed consumer. The only way to get your money back is to contact Google, and if necessary threaten them with legal action if it cost effective, which it probably isnt.
