This is a story of the coercive and abusive actions of Waste Management (WM) and how they were defeated. The point of the story is, like many big companies, they think they can push the little guy around over small dollars. Because who can afford the time and energy to fight them when they are threatening your credit and other actions. In my case, I was willing to fight them all the way.

I live in Marion County Ocala, Florida. Where I live, you have to individually contract for residential garbage pick up. There are no contracts, verbal or written, you simply PAY IN ADVANCE FOR 4 months of service. So for 2 years we had waste management doing residential trash pick up. We weren't happy with them because they missed pick ups and promised, but never fulfilled the promise to pick up the next day. But we continued to pay in advance. This summer, we decided to switch pick ups. At the last payment in May, we informed them that this would be the last pick up. In July, we received the bill for August, September, October and November. We didn't pay it, instead we had another company do the pick up. Waste Management stopped picking up.

In early September, we received a letter from a collection agency demanding payment for the next 4 months to November 2008. We contacted them on the phone and the agency threatened to file against our credit and take legal action due to our failure to pay, mind you in advance, for services we didn't want or receive. Since they threatened to harm us (our credit) and sue us, We had our attorney write a letter to Waste Management that they were not to contact us, but communicate with the attorney directly. Of course, the collection agency continued to call. But eventually did call our attorney.

The collection agency, writing on behalf of Waste Management, contacted our attorney to say that we owed a whopping $35. Again, for advanced payment or they were prepared to take immediate legal action.

However, since WM was unable to actually demonstrate that we owed money, or had a contract that said we owed money, Our attorney informed WM that they were out of compliance with the Federal Fair Debt Collection Agency. Only after we threatened a lawsuit against WM unless they dropped the matter did they call to apologize for the "misunderstanding."

Fortunately for me, my lawyer is in the family. But I recommend that anyone being wrongfully harassed over a bill, should cite the FEDERAL FAIR DEBT COLLECTIONS ACT. Force the company to prove the bill and let them know that you are prepared to take counter legal action if there claims are fraudulent
