YOU CAN'T GET IT?!! Make sure to scroll down to Jim's Rip Off Report at the WELLS FARGO page and read all about it! And imagine finding out that 'SECRET LIFE INSURANCE POLICIES' were being taken out on the LIVES of former & current employees of many of the large banks that received 'TARP' money from the government, which is TAXPAYER'S money?!! 'Google' this- RIP OFF REPORT BANK OF AMERICA JP MORGAN CHASE BEAR STEARNS, and read all about it. A Texas law firm is handling this case. GO READ IT NOW! WELLS FARGO WAS NAMED IN THIS REPORT! Where is the RipOff Report on your landlord who not only would not return your check, but went ahead and cashed it after you had given them cash? That is the REAL RipOff. Now, if you had a Stop Payment and Wells Fargo still cashed it, did they make an error..Yes. Should they return the money to you..Yes, especially if he went into a branch to cash it. But please say you at least have the receipt from the landlord for the cash you gave them. If not you have zero proof that you double paid them, and that is a problem for you. If Wells Fargo does refund the money and go after the ex-landlord. The ex can still go after you, but not only for the amount owed but any fees caused by the "returned" check. If Wells Fargo does not refund the check amount, they should at least refund the Stop Payment Fee(since it wasn't stopped). Then you need to go after the landlord for the double payment. The best would be through Small Claims, but again you need PROOF that you paid the cash and this was a double payment.

I'm not saying that Wells Fargo shouldn't have stopped the check, I just don't think you'll get anywhere with them. They likely have some kind of language to protect themselves. By the way, I know someone who placed a stop payment on a check and it was cashed anyways because the amount of the stop payment was off by a few cents. If you truly paid your landlord in cash and he still presented the check to the bank, you have a pretty good case against him. I hope you kept your receipts.
