I have been looking for a job to supplement my income even though I work 2 part time jobs.  I was hired as a Secret shopper and sent a check to deposit into my account at Wells Fargo Bank so I could perform the first secret shopper assignment.  I deposited the check thru the ATM like I do with all deposits.  

After 1 day, my husband and my joint account debit cards were being rejected.  We called Wells Fargo to find out why.  They transferred us to the fraud Dept.  A man told me that I deposited a counterfeit check into my separate account and the bank shut down all accounts with my ss# connected to them.  I was shocked.  The man told me that since I made the deposit thru the ATM, it makes the fraud even more serious.  Wells Fargo told me that I will never be able to have another bank account and all funds are frozen!  

Wells Fargo has taken all of our money and returned our mortgage payment the mortgage company!  They are holding our money hostage and we can't buy gas, food or pay our electric bill which is due now.  Well as Fargo is treating me like I am a criminal!  I am the victim of a fraud crime!

I think Wells Fargo has become too big for themselves.  I am waiting for the police to come and arrest this 60 year old woman who works 2 part time jobs for fraud.  I would like to find an attorney who will help me with this and get our money back.

I hate to tell you this but Wells Fargo is for the most part correct.

First off your money is gone..you are not getting it back.  Sorry but that is just the reality and there is really no good way to say that.

The fact is that YOU are responsible for any activity on your account.  This includes when you deposit a check you are making the assertion that it is a valid check.  As if you thought it was a fradulent check, you would be actually comitting a crime.  So  yes you are a victim, but so is Wells Fargo.  As such you become what is known as the "Holder in Due Course", meaning that the bank will make you responsible for the check.    As for them freezing any other account you may have, again that is totally valid as a result of this.  

Now, in "normal" circumstances in turn you would go after the person who gave you the check....but there is a problem these people gave you fake name, phone numbers that are "throw away" cell phones or VoIP phones that can be based anywhere in the world, Internet web sites and e-mail addresses paid on stolen credit cards.  Most likely if all of these points of contact haven't gone unanswered they will within the next few days.  The money you sent them was through Western Union or a Pre-Paid Debit card..again untraceable once the money is picked up.  Oh and they are not even in the US.  Making finding them next to impossible to find.  So any law enforcement activity will be no more than writing a police report and perhaps a quick check of the numbers you had.  This is also why any legitimate attorney won't even touch your case to help you get your money back because they know it isn't going to happen. 

As for the actual check, these scammers work on greed..yes greed.  After all do you really think you were able to make $100-$200+ for an hours worth of work?  This is what these people rely on, you seeing basically "free" money and ready to throw common sense out the door.  As a side note, legitimate "Secret Shopper" jobs pay anywhere from about $5-$25 per job..sometimes more if the shop is really advanced and specialized.  But also sometimes less if it is a super simple job.

Now, I said they were correct for the most part.  You will eventually be able to have another "regular" bank account.  However, it will be several years away and you will most likely need to make up for the money from the counterfeit check before you are allowed to.  Until then you can pretty much be guaranteed to be stuck with "second chance" banks that will open up accounts for you at much higher fees.

In the end, anytime someone you do not personally know and trust sends you a check and asks you to deposit it you MUST consider it a fraud and do not deposit it and defintly do not send them any money.  Regardless of how legitimate they make it sound.
