This is how the story began.

My check book was stolen 2 years ago. Immediatelly, I went to a branch closed the account, cancelled the last 3 checks on that check book and opened a new account. All of these per branch manager's instructions.

Everything was fine and normal for about 6 months. All of a sudden I checked my on-line statement on June 13,2002 and discovered check #1030 from my new account was reversed. I called the bank and inquired why the had reversed it, they said the merchant had requested to do so.

I called my Auto Insurance Co. and they informed me, they had not requested to reverse the funds and that their system showed the check was honored. I called WF back and this time the "customer service rep" told me that the check was fraudulent (now, I just happend to disagree with that since the "check" was an electronic transfer) I informed this to the CSR and he said, well, then you have no funds in your account, I just had to refute that one too since I have $5,000 as a reserve on that particular account and the check was only $55.08 with no other checks to be cleared.

So he said, oh no! you requested the check to be reveresed. At this point, I see a patern. I requested to speak to the manager and she gave me the run around too.

This went on and on for about a month. Finally they admitted they had made a "clerical error" Which in reality ment, they never updated the notes on the system showing I had cancelled check #1030 from my previous account.

Needless to say that by then the Auto Insurance Co. had cancelled my auto policy. - State Insurance Regulations- Since it was not their fault and WF denied they had made a mistake. Not even going down the DMV path...

My financial advisor suggested I write to the President/ CEO of WF,Richard Kovacevich, and 2 weeks after I received a call from their "legal advisor" whom I worked with for over 4 months to clean up their mess.

Finally, I received compensations for most of the damages I incurred on. I still have the DMV to deal with.

I strongly recommend you to contact the Office of the Comptroller of the Currency. They will be able to assist you in getting a resolution.

When dealing with a large corporation; try to collect as much information as you can. Names, extensions, time and date of your call. Always schedule a follow up call.

Hi- There is a big class action suit underway against this bank on behalf of California customers. You might want to let the Attorney General know about your problems with Wells Fargo. Your problem might not relate exactly to what the class action suit is about (I don't have the details), but regulators fine companies when patterns of ineptitude and rip-offs are detected. The more complaints, the higher the fines. Plus, they will be watched by the regulators more closely, which usually means they get their act together or go out of business. Good luck to you!
