I have an HR degree with a minor in law, and what I can tell you is that is bogus! You are right, an arrest is not the same as a conviction. Going forward, if that arrest is the only thing and you were not convicted of it or any other crime. I would not disclose it. Companies and Human Resource professionals use outsourced companies that do automatic background checks. Often times, only law enforcement agencies have any records of prior arrests. So if you were only arrested and never convicted you should consider yourself to have a clean criminal history.
