One saturday, my wife and I decided to lease a car with Windsor Nissan.  We signed a lease but also they informed us that the loan is conditional pending bank approval.  They had us sign a document stating that the vehicle is under temporary possession until all credit info is obtained and if it is unsatisfactory to the dealer and the financial institution, we have to return te car.  

On Monday, we received a message saying that the loan got approved but for a higher rate and we had to re-sign a contract. He also mentioned it was conditional pending bank approval so they can do that.  I called him back to let him know I will return the car.  Since it was deemed conditional and was not finalized, I should have the right to return the car.  So I went to another nissan dealership which was able to match my price with a higher trim, same car.  That same day, I retuned the car to Windsor and was given a very hard time.  At first they told me I can come back tomorrow to talk about it.

But when I told them I bought a car already, the finance manager told me to go to his office.  He then tells me that he will give me a better rate.  I told him I don't want to but he kept insisting. He then tells me I aleady approved and signed the contract therefor I have to keep the car.  I told him the contract is conditional according to the voice message and the additional document I signed.  He started threatening me saying the car is mine and that he will send the car in my driveway the next morning. So I started walking away and he followed me and started pushing all the paper works on my chest.  I left the car there.

In a few days, I was scared that they actually processes my application to the bank and the bank did approve it the first time.   so I was able to contact the bank and they told us that we have two vehiclea under our name and that both were approved.  I explained to them that one account was due to fraud because there was a conditional clause to the contract and the dealership told me a lie which made me believe the contract was never finalized.  

I am now in contact with nissan consumer affairs and the motor acceptance corp to resolve the issue.  I am also trying to pursue legal actions against them.  I have copies of the contracts and the conditional contract and the voice message the finance manager has sent me.  The contract was presented to me as a conditional contract therefore is not a finalized contract.  They committed a fraud by calling me back in a few days and saying I got approved only for a higher rate and that I needed to resign a new contract.  I should have every right to return the vehicle.

This dealership practices spot delivery financing fraud.  Where they make a person sign a contract and they call them back stating they need to put more money down or re-sign another contract to finalize a deal.  Those customers who are attached to the car already will most likely sign.  Those who refuse to come back to the dealer to resign will probably get their car repo'd, that's what the other document is for.  Those like me who retUrns the car will be harassed and threatened.  

The bank will already have a lease under their name that you will end up paying for or being penalized for, for surrendering it.  Stay away from this dealership, they are frauds.  If you have been scammed like me, call a lawyer, spread the word everywhere you can.  Call Nissan corporate, the bank, etc.  File a complaint to the attorney general which I will do.  Do not give up because of you do, they will stay in business and will keep scamming people.
