Tell us has your experience with this business or person been good? What's this?

So, we didn't have perfect credit! We are normal hard working people trying to raise our kids. We purchased a vehicle from this place, paid $4000.00 down in February of 2010. Our goal was to pay off & mail the report to all 3 credit bureaus, to establish & rebuild our credit. Upon the initial payments I noticed they seemed off schedule. We immediatley call Working Mans Auto & asked why? The salesman at the time told us that the payments were every 2 weeks. I was kinda surprised because we specifically asked for the due dates to coincide with our paydates prior to signing the contract. Never the less we asked to have the dates changed to our paydates so it wouldn't reflect a late payment. They declined 3 months I continued to pay my car note & argue to please change dates, I offered to please set it for automatic draft & debit my account every pay period. They declined & refused to change the dates. I was upset but continued to make my payments every 2 weeks even though the dates did not coincide. 8 months into paying the vehicle (October) I received a call at my job from "Riley" stating that we were "late" I explaine dto him that I was getting paid the following day & would call him in the morning with my creditcard. The following morning I did just that. I called & asked them to charge the current amount on my card. "Michelle" notified me that we were a payment behind because of the way the due dates were set up, so I now owed $360.00. I was not prepared to pay that but offered to pay the current $200 & told her that in 2 days I would take in the other $160, they refused to accept my payment because it wasn't in "full" this was at 9am at 2pm they repo my car! I was furious & called them, why would they do that? I was giving them money that morning & all 'Michelle" did was tell me that we always paid late! Ha! I explaine dto her that she knew they were wrong because we tried to clear this by changing the dates way in advance. She told us we now owed repo fee plus all sorts of fees = $800, I called borrowed money & by 4pm I called her back to charge the $800 on my card. They declined & said that since they had repo the car I had defaulted on the loan & that I had to wait on Mr. Morris to see if he was still willing to finance me/us to call back. That afternoon at 5pm they told me he did not want to reinstate us & we had 10 days to refinance the $10,000 of course no bank re-finances an upside down loan on a used vehicle! So that is it! End of story, he screwed us. I tried talking to Mr. Morris only to find out what a scum he truly is, while I could go into details as to how this dealer treats people! I would like to inform the public of the following:

1. DO NOT BUY from him!

2. I found out he does not have a financing license to do in house financing like he does.

3. There has been 3 complaints filed on BBB mine would have been the 4th but I refused to mediate with this man.

4. He does not hold a license to tow with TDLR> He can't tow your vehicle with a wrecker.

I have filled a complaint with TXDMV, OCCC & ATTORNEY GENERAL....if he scummed you, I suggest you do the same. I work hard for my money & just because I don't have perfect credit does not give anyone the right to steal from me.

You are absolutely right if you are aludding to dishonesty on the part of the salesman if it was a deliberate attempt to lie to you about the due dates.  You are also right when you stated you cannot trust anyone...and let me add...IN THE SLEAZY AMERICAN CAR BUSINESS.  Even if you are making a deal with the Pope, you should read the contract BEFORE signing it!  Sometimes there are mistakes and sometimes there's deliberate fraud.

"Late" is defined as not making the payment on or before the DUE DATE as stated in the contract.  Being one day late is STILL late.  Anytime you are "LATE", even one day, you are looking directly down the barrel of a repo.  You admitted you were a subprime borrower.  Lenders which do business with subprime borrowers manage their accounts much closer than in prime.  As such, they've heard every excuse, every lie and every con-game attempted by the borrower as an excuse for not living up to the exact terms of the contract.  Understand me, I'm not saying you lied to them!  They are regularly screwed over by subprime borrowers and as such, they don't mess around when it comes to protecting their interest...the car.  All this stuff about changing the payment date is meaningless to them until and unless they officially change it.  Until then, the CONTRACTED payment date is still in effect and is the reference point for determining if you are making payments on time.

One more thing...I don't know you from Adam or Eve.  But I do know something about you.  Your health and your stomach lining are much too valuable to be destroyed by your efforts to "get even" with them.  If you were so concerned about them allegedly not having the proper licensing, why did you do business with them?  Lets suppose you didn't know, what in the hell difference did it make?  You got your car and you would still have it if you would have made on time payments!  Your concern with getting even will do more damage to you than them.  You are much too important and valuable to be playing around with such immature BS!

It is a rip-off

The rip-off is in the fact that we requested dates prior to signing & the salesman agreed, we were neglient in double checking his work prior to signing, I guess these days you can't assume people will do their jobs. Our oversight does not make up for the fact that this dealer is shady & un-ethical, financing vehicles with out a financing license & clearly he accepted 16 payments with no such problem. We are talking about a 5000-6000 that was lost over the dealers un-ethical behavior, who do you know looses their vehicle over 11 days late ? If you look in here I am not the only person who has filled a complaint about this dealer.

If the dates weren't changed...

You said you noticed after the fact the due dates weren't what you wanted? Why didn't you read the contract before you signed it soyou could have headed this off at the pass? Then when they refused to change the dates you continued to make every payment late. The contract governs your performance not what you want to do. Unless and until it is changed by them and not you the payments are due when the contract says they are. There's no rip off here.
