I purchased a Mercedes from World Motors two years ago along with a third party warranty. A few days after I decided to cancel the warranty as it did not meet my needs. The insurance company refunded the money to the dealership that was supposed to refund all monies to the customer (me). They did not do so. The insurance company also said this was not the first time they have seen this from World Motors. Since then we have been to court twice. They have lost both times. I have recently filed the judgment with the state of Arizona. This judgment is collecting interest from the original date it was issued. I now will be placing liens on personal property. As a matter of principle I will continue to spend money needed to satisfy the judgment against world motors. See case history below.

Glad it worked out for you. A certified, return receipt requested letter that demands payment usually works-proof positive that a payment demand was made. Next time, don't wait so long to demand the judgment be satisfied (wink.)

I spoke with the courts and will be taking your advise after the time allotted in the certified letter is expired. Contempt of court is going to cost them allot more. I will also discuss with the judge to get the additional $2750 that somehow was adjusted without me knowing. I just happen to be on vacation when the allotted time for paying me is up so I get to hang out at the courthouse and get this ball rolling. :-) Meanwhile I will continue to search the internet for anything World Motors related to it and give my opinion. Dont believe me just do a search on google. Tylor you should probably call me to arrange to make payment ASAP. $3976 DUE IN FULL. This is not up for negotiation. I will not back off until this judgment is satisfied. Here is a breakdown of the charges you OWE. $2085 judgment Amount $1250 Attorney Fees $555.90 10% annum interest 20 months $85.50 Transfer judgment fees Total $3976.40

""What good does it do if they won't pay it?"" Two words; ENFORCEMENT ORDER. ""The original judgment was from over two years ago. I guess out of principle because they are such jerks about it and tell me that they will sue me if I don't accept the offer. They make things up like I traded in a car with a bad engine."" I don't understand why you waited over 2 years from the award date to take further action. I would have given them 45 days from the court award date and then I would have visited the clerk of the court on day 46 seeking an enforcement order. BTW, the time for them to SUE YOU would have been during the procedings of your case against them. That was the time for them to countersue you for any alleged "fraud" on your part. Their threats now are just that and any reasonable judge will see that. Further, in some jurisdiction (as here in western NY) it is ILLEGAL to make such threats of misuse of judicial process to avoid satisfying a civil judgment. It may be so in your jurisdiction so I suggest you consult with your attorney. ""Who knows what else they are going to make up. I don't feel like incurring any more attorney fees at this point so I may as well take care of my blood pressure by sort of getting even I guess."" The best way to "get even" is to have the court COMPELL their compliance with the court order. ""Paid and the satisfaction of hitting them in the pocket by discouraging sales from future customers."" Enforcement of the judgment will hit them in the pocket better than anyone marching back and forth with a "they screwed me" sign waving in the wind. Also, if you sued them in a court higher than small claims, you normally can ask the court for reasonable attorney fees as part of the award. I think you should VISIT (not telephone) the clerk of the court that granted the award. Most judges don't like their orders being disregarded (it's an ego thing) and are almost eager to teach someone who doesn't comply a lesson-a costly lesson. As I stated, YOU HAVE THE UPPER HAND with them. You have a judgment inwhich they have yet to comply. However, the judge will very likely ask you how many times you have demanded payment. This is where a certified, return receipt requested letter comes in-it's your proof that you've demanded payment of the judgment. Itemized telephone records are good as well if they show their telephone number on the records. Good luck. ""I will head on down to the courthouse this week and see what other options I can place upon them. Thank you again for input. It helps bring me down to earth and not waste my valuable energy on people like this."" You're welcome. In the future, do NOT wait so long to take further action with such judgments. Also, if you sue someone again, ask the court to stipulate a compliance date in the award. In other words, you want the judgment to state something to the effect that the defendant will pay XXX amount within XX days (or by XXXXXXXX date) or be held in contempt. I have accomplished this twice in small claims court-both awards stipulated a date inwhich the award was supposed to be paid. This made getting a levy against a bank account a quick matter-I didn't even see the judge as the clerk handled all the paperwork. Oh, and the additional court fees for the levy were automatically ADDED to the award. Again, good luck.

Yes I have a judgment in hand. What good does it do if they won't pay it? I have also recorded it with the Superior court which put a restriction on just about anything they do with their business. Its been two months since I have placed it there. The original judgment was from over two years ago. I wouldn't waste my time organizing protests, marches, publicity campaigns, etc. IF I had a civil judgment in-hand against them. Simply send them a demand letter as I mentioned before. If they don't pay up, you go to the clerk of the court that awarded you the judgment and request enforcement orders and ask that the court find them in contempt of court. You might wish to consult with an attorney about the possibility of placing a LIEN AGAINST THEIR INVENTORY. If this is permitted in your state, that would effectively prevent them for SELLING any vehicles in their inventory without your permission until the lien is released. You do have a civil judgment against them, correct? Protest marches and so forth are for folks who DON'T HAVE JUDICIAL REMEDY available to get what they want-YOU DO (civil judgment.) It's a simple matter to approach the court for enforcement of the order.

No word from World Motors LLC. Beginning this Saturday at 10:00 AM we will be having a little business discouraging protest in front of World Motors. Robert, That's great advice. Thank you. You're absolutely correct. I will do so. I have a few other things up my sleeve like contacting the IRS on Wednesday to make sure they claimed that stolen money as income. This should bring some attention to their books as well. And if they treat customers this way I am sure the books cant be any better. lol I won't give away the other two legal actions I am going to take later this week. I am done messing around with this company. I shouldn't have waited two years to do so. Its not even about the money any more. I paid more than the settlement was for anyway to my lawyer. But I will definitely take your advice and go from here. This is actually kind of entertaining at this point. I should just let it grow. Where else can I get 10% on my money in this economy? :-)

I would not negotiate any settlement with them. And if I were to negotiate, it would be in writing ONLY-no deals over the telephone. I would mail them a certified, return receipt requested letter demanding the full amount of the court award including interest. I would propose to them a counter offer in that if I receive a bank cashier's check for $3300 (nice round off) within 14 calendar days after their receipt of the letter, that I will file a notice with the court that the judgment is satisfied. Include in your letter a table that clearly indicates the court award amount and shows how the court awarded interest is calculated to reach the total amount your are demanding. I would also state in the letter that if a payment of $3300 is NOT received within 14 calendar days after their receipt of the letter, that I will file with the court to request an enforcement order to levy their business bank accounts and attach a lien against their business property (location where they conduct business.) Also inform them that you will be asking the court to find them in contempt of court and request the court to sanction them accordingly. That should do it nicely. If you don't receive remittance, follow through with the court enforcement orders and ask the court to go after them for contempt of court. Good luck.

Tylor Thompson wanted to settle with paying me the exact amount of the warranty cost for $2085 and threatened me if I didn't accept that he would sue me on a separate issue for trading in a car with a bad engine. Funny he brings this up two years later. Pretty insulting if you ask me. I traded in a 2003 Jaguar that still had a factory warranty. I still have a copy of the factory warranty agreement in hand. Dont you think I would have had the engine replaced. lol I did not agree to this as it is clearly a judgment that he has to pay according to the state law. Again please see judgment below. I will continue to post on every site to make this case as visible as possible to make the public and any possible customers. I did tell Tylor that my counter offer stands to waive the interest that has accrued for two years.
