I contracted with Yacht Path in March 2011 through their Sales Manager Colleen Cummings to carry my boat as deck cargo on their ship from Ensenada, MX to Victoria, BC, on their WB-04-11 Voyage, and I paid them $16550 on March 21. This Voyage was subsequently cancelled by Yacht Path in mid-May, Yacht Path offered me two totally unacceptable alternate voyages, and Yacht Path finally agreed in phone conversations and Emails several times to refund the entire $16550 to me.

Yacht Path's senior manager, Kevin Cummings (Colleen Cummings' brother), promised us, in a phone conversation on May 11, that the funds would be fully refunded and wire-transferred to us the next day, Friday May 13 (that didn't happen); then he promised, in an Email to me, that the wire transfer would happen by Wednesday, May 18 (again, that didn't happen); then he said in an Email that he would check and advise us about the status of the wire transfer on Friday, May 20 (and that didn't happen); then he promised in an Email that the wire transfer would happen "without fail" the week of May 23 (and again, that didn't happen)! (I have hard-copies of all these cited Emails)

[So that you are not confused, the Owners of Yacht Path are two brothers -- the Principal Officers Dennis Cummings and Kevin Cummings -- and a sister -- Sales Director Colleen Cummings]

I have hard-copies of all the numerous Emails from Kevin Cummings which state that they (Yacht Path) "acknowledge and agree to refund you your 16550 USD back in full. We do not contest this". Dennis Cummings and Colleen Cummings have been kept fully informed by Email about these promises, and have remained silent, and they have ignored my pleas for communication on this subject. I have received no recent communication from Colleen Cummings since her Email of May 3, in which she says that "I SINCERELY, SINCERELY apologize for what has occurred. I will speak with Kevin in regards to resolving the situation and either him or Dennis will be getting back with you. Again, I am truly sorry." ...but Dennis refuses to respond to my Emails and Kevin just makes promises which are not kept, that the refund is "in process"; those un-kept promises that the refund is "in process" are months old now, and still no refund!

Update #2

I should add the clarification/comment that, following the verbal resolution of our dispute with Yacht Path, they refunded our money IN FULL immediately; it was wired to our bank the following day.  As far as we are concerned, our dispute with Yacht Path has been fully resolved to our total satisfaction.

Rip-off Reports Addendum 1 (September 2, 2011)
 
After Yacht Path agreed to fully refund our money, we experienced several extremely frustrating months of the check is in the mail, eventually followed by Yacht Paths refusal to respond to our Emails or to communicate with us.  We sought the assistance of the BoatUS Consumer Protection Bureau, and following BoatUSs intervention, Yacht Path finally refunded our money in total on September 1, 2011.  We are confident that this refund would not have occurred without the extremely professional and diligent efforts of BoatUS and their Consumer Protection Bureau Coordinator, Debbie!
