When I was having trouble paying credit card debt we went through a consolidation place. was going well until a credit card company decided to send us to collections, yep Zwicker and a*s. (Thats how I address the envelope). I tried to explain we were going through debt consolidation, they wouldnt hear of it. We made a payment arrangement of 171.00 per month. I was paying that and next thing I know we are getting papers for a court date! I called and asked why, they said because I was just paying random amounts! I sent them the paper with the agreement on it and they disregarded it! When I asked them to send me a pay off amount so I knew that my payments were being applied, they sent me an amount and said was due in 2 weeks! I explained that I just wanted a balance and they took us to court again! Now they put a lien on our house! I have been paying them. I was paying double payments (171.00 + 171.00=342.00) I guess that's where they got the "random amounts". They are rude, and don't have a clue what they are doing.

I believe I handled your file while working for the firm. I handled all post judgment matters, so the lien on your home makes me believe I did handle it. Also the "Zwicker & a*s." comment reminded me of the letters that used to crack me up. I just wanted to advise you that you left yourself open to be filed against due to defaulting on your payments. As you said in your post, you made "double payments". When you did that, I'm assuming you skipped the following month as you paid double the month prior, correct? That means you are in default. Payments need to be monthly. Thats why the letter provided calls it a monthly payment plan. As for your debt managment company; it doesn't matter that you are paying them to pay your creditors. If they aren't sending the money to your creditors (which happens ALOT) then your creditors will come after you. I know your post is old, but if you're still having this issue, I'd call your DMC and have them start paying ASAP.

It looks like Rip Off Report redacted my links on how to fight debt collector lawsuits for Hanna and Zwicker, and for help blogs. For help with the lawsuits you can do a Google search for a book and webtsite by Allen Harkleroad titled “Stick it to sue happy debt collectors.” The help blog I linked is Next Level Unlimited Credit. I do not have any stake in any of these sites, I am just posting to try to help other consumers. I do understand why Rip Off Report redacts links though.
