 There was no written contract between us. I just call for there services and they did gave one service and i paid for it. On phone they never told me about $79 charge. Even when they came for visit, there never told about it.

I am a consumer, just like you. I have no affliation with this company at all and I can see why you are upset at a cancellation fee.

A contract cuts both ways. If you signed a written agreement, then check it to see if there is a cancellation penalty (in writing). If so, how much is the penalty?  Also check for the required method to cancel. Most written contracts require a written cancellation and not a verbal one. I know it's a common saying, but read the contract before you sign. If you can't read it because the electronic version only contains the signature page, that is a huge red flag. Make the vendor print out a copy so you can see ALL the terms and conditions. It is becoming a sad thing that vendors now present only the signature page and not the entire contract and that we have to ask to see the whole thing. 

Having said the above, if there is no written, signed contract, how can they charge you a fee?  It would be almost impossible to enforce IMO. The representative that threatened to take you to an attorney for $79 seems to be way out of line. They might try a collections agency, but an attorney? No, doesn't sound reasonable at all to me. Kind of like hitting a fly with a sledgehammer - and costing a whole lot more than what the fee would generate even if they pass on attorney fees to you the collections agency is going to take almost 100% of the fee for their cost to collect! 

Since you paid by credit card, you can contest the charge if it isn't authorized by you and isn't in the agreement if they charged you without consent. It needs to be done right away. I think, but am not 100% sure, that the time frame is within 60 days of the false charge.
