On May 1, 2013, I toured and placed a deposit on an apartment with 82 Flats, a Barrett and Stokely community in Indianapolis, IN.  At that time, I was directly promised and clearly told that the new swimming pool would be open by Memorial Day.  This was a singular factor in renting here.  Upon signing the lease on May 31st, no work had progressed on the new swimming pool and the leasing staff specifically promised the pool would be ready in two weeks.  Construction did not begin until late June and I was promised it would be ready by July 4th.  As of today, July 17th, the pool is far from completion and although leasing staff are indicating an August completion date, it's clear that timeline is very unlikely given construction status.  I was presented with deceptive and false information in order to secure a signed lease.

I complained in writing to the management company, Barrett and Stokely, on July 15 and was contacted by regional manager Suzanne Peperak on July 16th.  Suzanne refused to offer any concession...I simply requested a reasonable credit commensurate with the cost of a two month local pool membership.  Suzanne indicated that she would not offer anything for one amenity that was not ready as her staff clearly promised.  However, in speaking with other residents - I found out that the staff have given multiple gift cards and pool passes to other residents who complained about the same issue as well as other construction inconviences that I've experienced since moving in.

I was denied any type of concession based both on my sex and my sexual orientation.  One resident, Jill, was given $500 in gift cards for inconviences caused by construction and amenities not being ready at move-in.  However, Suzanne Peperak failed to offer me any concession for similar challenges with the onsite construction issues.

After a detailed meeting with Suzanne on July 17, the issue has now been thoroughly addressed with a determination of appropriate compensation pending from Barrett and Stokely.

 I guess some people are just pre-disposed to see discrimination in everything.  Where in the heck is anything in your report that indicates that they refused any sort of compensation because of your sex or sexual orientation.    Well at least you didn't say that they haven't completed the pool just because they don't want your sex or sexual orientation to use it..so at least I give you some credit for that.

Were you promissed this in writing that it would be ready?

Perhaps the management company has been saying the pool will be ready in a few weeks for months..or even years.  So perhaps the tenants who have been there LONGER are more deserving of some sort of compensation.   Perhaps the other tenants have had more inconvienences than you.
