I had a vehicle insured with this company for my 2007 Ford Mustang.  I was the only owner on the vehicle however, my mother was listed as an insured.  I moved to Georgia from California leaving this vehicle with her.  I sent her the paperwork to transfer the vehicle into her name in August 2012.  She did around August 21, 2012.  I was no longer the owner of the vehicle or insured as of August 1, 2012 when I signed the TRANSFER OF LIABILITY.  Unfortunately, because of the 2000+ mile difference between us, I could not take her down to the DMV to transfer the vehicle out of my name.  It was up to her.  I am now being threated by AAA to be sent to collections over $66.41 for insurance premiums up until September 1, 2012.  Unfortunately, I had forgotten to cancel the insurance prior to September 1 because I was too busy working 20 hours/day but I did call on that day and explained the situation.  Now I'm being forced to pay insurance on a vehicle that is not/was not mine because there's no bill of sale because I did not sell the vehicle to her, rather I gave it to her.

You gave your Mom the Transfer of Liability Form and she didn't go for almost 3 weeks.  You forgot to actually cancel the insurance.  So of course this is all their fault and they are the one's in the wrong.

Unless you can prove that your mom had separate insurance from another company in her name, this money is most likely owed.  Even if she did it is going to be hard to get the money back because they already provided the service..even though you had no claims.  If they give you this refund..you would actually be in violation of the law by having an uninsured vehicle.  While you don't want to hear this, unless you are leaving out a lot of information it sounds like if anyone owes this money it is your mom, so are you going to go to her and have her pay you back?

Also, I have no idea where you got the idea you had to physically go to the DMV.  If you actually read the Transfer of Liability Form you can mail, or even submit the form on-line.  A copy of the form is from the link below.

By the way, just be lucky that their isn't a Bill of Sale.  As with that proof both you and your mom would technically be in violation of the law(don't you just love CA and all of their laws) as the CA DMV requires that form to be sent within 5 days of the transaction.
