Okay sooo.. I received a letter in the mail on January 28th, 2008. On the envelope and on the letter head of the letter it read Norman G. Kalina, Esq.

(You can totally tell that this letter is soo fake) Well in the letter it read that I owe them an amount of $130.77 for Levi's outlet. Well this was for a unpaid check which I have no problems paying off my debt. Mind you this was done in 2005 and they are now contacting me about it. I am guessing because it is tax season. Here is exactly what the letter read:

Ms.Torres,

You have not responded to our previous letters regarding the above referenced dishonored check. Check fraud is a crime. Please forward a Western Union "Quick Collect" certified check or money order to the above address payable to NORMAN G. KALINA, ESQ.

We are preparing to recommend further legal action against you for the issuance of dishonored check. Please be advised that if payment is not received within 10 DAYS, we may proceed legally against you for the demanded amount, plus our legal fees and court costs. We are required by law to furnish this notice prior to legal action.

If you have any questions, feel free to contact my office immediately at 201-670-8851.

And at the end of the letter was a stamped signature.

So I called the company and the secretary answered and she referred me over to a woman by the name of Ms. Harper, she was very rude, I told her that I am more than willing to pay my debt but that I would like to make payment arrangements because I am currently out of work, she responded by saying Maam we dont care about your life problems we need the money and it cant be split into payments, she said maybe you should ask your family or someone to give you the money and I told her that I am unable and will not do that. She got real nasty with me and said well a warrant will be put out for your arrest and we will notify the DMV, I said what does the DMV have to do with this? She said well we will have them suspend your liscence. I said Okay lady whatever you have to do, DO IT! I told her that she didnt scare me and that made her even more mad and she was screaming to where I couldnt even understand what she said and hung up on me. So I waited about 10 minutes and I called back again and the secretary answered her name was Sheila and I explained to her the information and everthing that happened with Mrs. Harper and she said she would talk to her supervisor and she would get back with me. Which she hasnt.

I am so glad that I followed my gut instinct and researched there company.

I was really worried and I didnt know what to do I was soo upset considering I have a 2yr old and I am a single mother the last thing I want is to go to jail.

Please if anyone finds anything else out about this company let me know. Something needs to be done for the way they treat people.

I really dont know what I should do if I should pay them or should I contact someone??

ok this goes out to the dummy who had the d*mn nerve to complain about the collection agency that she owed money to and not truly look at herself and what she has done!

This goes out to the dummy who posts a rebuttal to a FOUR YEAR OLD REPORT.

first off your considered as a bad check writer and usually when you have written one bad check and turn
around not pay it for years to where you have ended up in the bad check system, i am pretty sure there is other bad checks lurking out there in your name,,,, !!!!!

This goes out to the dummy who doesn't use commas properly and doesn't know the difference between "your" and "you're" (you are) and is fond of run-on sentences.

in my book that is stealing............ and if you was such and honest person it would not have taken you years to pay for these items.

This goes out to the dummy who can't conjugate the past tense of "to be"  "you was" should be "you were."

you cant possibly look at the merchandise youve stole and walk around with your head high,

This goes out to the dummy who can't properly type "can"t" and has more conjugation issues:  "youve stole" should be "you've stolen" or "you have stolen."

in my book that is stealing............ and if you was such and honest person it would not have taken you years to pay for these items. you cant possibly look at the merchandise youve stole and walk around with your head high,,,, and really what kind of example are you teaching your child? to become a dead beat!!!! secondly your upset about it being with the collection agency!!!! but why ? it is your responsibility to to make good on a bad check with in three to five business days that the check has bounced. or at least contact the people whom you wrote the check out to and take care of it.

it is not the collection agency's fault ... its your own. what kills me with people is they write bad checks then not pay it and then years down the line, because it has affected something your trying to apply such as a credit card or buy a home or car and in order to do that must clear up past debts the you have the nerve to fix your face and complain about the extra fees. you cant write a bad check and turn around 5 or 8 years later expect to pay the same face amount.... that is crazy. your a bad check writer if you should be mad at anyone it should be yourself for making those choices in life.

I read with absolute disgust Bill's comments towards Analisa's experience. You, Bill, are the one who should be ashamed of yourself. You don't know a damned thing about the young lady or her situation. I had a similar situation happen to me with the same debt collector..and to set the record straight: in my situation, I had the money in the bank to cover the check that I had written. The problem in my situation was that I had some fraudulent transactions go through my account at the time the check was written, which caused my account to go into an overdraft status. Also, during that time I lost my job. It wasn't my fault that the check bounced. Save for those fraudulent transactions, the check would have gone through. Also, what about someone whose checkbook stolen and their account is bled dry? You have a lot of nerve to chastise someone about their situation when you don't know a darn thing about it. I paid off my account with ACA Recovery and was told that within one week I would receive a letter stating that the account was paid in full. That was eight months ago and I still have not received it. I've also contacted Certegey, the company who insures checks and they told me that they have no record from ACA that the check was paid. To add insult to injury, I'm still getting letters, just like the one Analisa received,threatening me with legal action, even though the check was paid off in January!!! So unless you know for a fact about a situation, don't pass judgement.

Most merchants that hire these check recovery companies don't receive more than the principle owed IF that. In states like South Carolina, trebling or tripling of the amount owed within a very short window (30 days from date the check was written, NOT returned/dishonoured) plus the piling on of attorney and court "costs" are the common scam practice of these outfits. Dealing with the merchant themselves is often straight forward and the least expensive for everyone involved. Having to deal with these check recovery scam artists can be a complete nightmare. You make arrangements, then find out the "arrangement" was changed without your knowledge much less consent to repay the amount owed. When you try to inquire as to why, you're given the ole' "Pay what we SAY you owe or you go to jail" routine. When dealing with some out-of-control cubicle dweller you're forced to ask for a senior manager, they ALL out refuse to divulge the information, give you the name of the owner on the business license, or the name of the attorney they're threatening you with. In a case I had today, where a previous arrangement was not only changed, but denied even to have existed by an insolent twenty-something at a check recovery outfit in Greenville, SC, I called the merchant directly in North Carolina. The check liason person at this grocery chain was able to peek into the Greenville companie's system and SEE exactly what chronologically had transpired including "the original agreement". This person said this original agreement was acceptable to they, the client, and she would "urge" this recovery outfit to honor their original agreement. She did warn however that sometimes these companies "get mad" and try to prosecute anyway. I appreciated her assistance but reminded her that as their "collection agent", the behavior of their hired "hand" did nothnig to recover the grocery chains funds BUT also reflected in a very negative way on the grocery chain itself. The bank played a mickey mouse game dishonoring and holding LEGITIMATE deposits causing an overdraft situation. The banks multiple fees dominoed to the point, my "so-called" overdraft protection was absorbed by said fees. This caused them to send back checks, undocumented and documented written by me to merchants. 36 hours later, my account was closed with very little documentation from the bank. I am left to find out myself where the checks are being handled and the documentation I finally receiver is post marked to appear to be weeks older giving me merely a week or so to cure the problem per the letters date (BTW, none of these are certified letters proving delivery or origin). Some of these letters also include WRONG reference/case numbers. NOW, I'm dealing with these sheister's and their own form of debtor's prison threats. I have found solution in going around them and dealing with the merchant directly.

This is just another example of the uneducated responses you can expect from a debt collector. FYI...In NV...where the OP lives...a bad check must be in excess of $250 to be considered criminal. And, guess what else? Any merchant who wants to prosecute any bad check in the State of NV, MUST put it through the bad check program. This is the first step in the process. If this is not done, the law prevents any further action. Therefore, as the merchant, you couldn't put anyone in jail for that check. And, you really should learn how to spell too. Coming, NOT comming. Writing, NOT writting.
