Nemo, If they are actually suing you, be sure that you don't ignore any legal papers. REAL legal process will have the name of a court on it, not just the name of a lawyer. If this is a simple administrative mistake, you should be able to clear it up rather easily with the cooperation of the loan company (who is, presumably, ACS's client). If such is the case, I wouldn't get too worked up about it, or be too quick to shout "scam." I certainly wouldn't waste my money on an attorney if you can make this go away without one. Don't be too frightened by the fact that they have all of this personal information on you. It's not all that out of the ordinary considering that you probably had to provide this info to get the loan in the first place. Caution is always warranted in these situations. But the likelihood that you will be victimized by virtue of their having this information is small. And, FYI, any attorney can get all of your identifying information rather easily, and legally, so long as there is a legally acceptable purpose for obtaining the information (i.e. debt collection).
