My wife and I purchased a home from what was called RSD Group. Turns out it was Advanced Builders of California.

We noticed the floor was uneven, turns out the Cement Contractor had left in the middle of the job and never finished. This Contractor/Builder hired Day Labor and a rental floor grinder to even the floor. It was never even.

We complained to the County of Riverside, Office of Building and Safety. Turns out we live in a home that was NEVER FINAL INSPECTED. They were very embarassed but turns out they swept the whole thing under the rug. We contacted the California State License Board. They would not take a complaint. We contacted the Federal Board of Consumer Affairs about the State License Board. Now we get a reply, California State License board takes our case. They send out and inspector, he just skips over anything like Doors Dragging, Carpet coming up, etc. Just what he called Major Item would be addressed.

Even with his skippng around, we ended up with a $20,000.00 Claim. The inspector asked the County of Riverside for the plans on our home; to determine if the Electrical, Plumbing etc. was in order. The Riverside County Board of Building and Safety stated they had destroyed the plans by mistake, and did not have them. We saw those plan but they would not give us a copy, however, our home is 26 feet back from where it should be, so was built on land that was never compacted. Due to a large boulder in the yard found during construction.

We contact our local County Supervisor. He sends out an assistant, who was hot about the whole thing, going to get to the bottom of this with the county, then sends us a letter saying that the house is final and if we don't like it, Sue the County of Riverside. Every lawyer in the area will only take the case if it is 15 or more homes for a Class Action.

We still have no final inspection. Escrow says call the Title Insurance Company. The Title Insurance says to talk to the Escrow Company. So we are screwed all the way around.

The home continues to sink, now are pending arbritration against the builder sometime in August of 2003.

Research about the builder we found that the individual with initials R.R. never had a license. He had sent in a renewl with his brothers name, changed the name back in 1979, and got his own licnese with out even taking the test. He has practiced under this license for several years. We looked up his license and his brother as well. Their Previous License numbers were exactly the same.

The California State License board states that an individual can never have the Same License Number as another. Then changes their story and says that they must have been a Joint Company.

Amazing...Politics, Politics, Politics.

After arbitration we plan to Sue the County of Riverside, Sue the County Supervisor, and get this whole thing on Television. Turns out this is Typical for the Temecula, Murrieta Ca areas. Some inspectors with the COunty of Riverside DRIVE BY THE JOBSITE to never actually inspect the homes!!!!

The reality of a home owner's legal recourse...

You found out first hand that a home owners legal recourse against a bad builder stinks. The gov't officials that are supposed to be doing inspections often don't. The regulatory agencies responsible for pulling a bad builders license also often don't do their job. The public doesn't find out how corrupt it is until they get a defectively built new home. Despite the reality, builders associations claim everyone is easily suing them for huge awards, and they are getting our elected officials to change laws to protect builders. This kind of crappy product and crappy service is why sites like the Rip off Report exist, and why organizations such as Homeowners Against Deficient Dwellings exist: www.hadd.com There is a California chapter, too, under state chapters on the hadd site.
