For the past 8 years I have been dealing with a corrupt HOA (Home Owner’s Association) that has been going on for the past 8 years.

Now in 2 days they are auctioning off my house for fraudulent fines placed on my account.



I've also been dealing with a serious progressive debilitating illness for several years.

Before my illness advanced to the point where I was no longer able to work, I held several jobs to pay off my home. I wanted to be able to leave my home to my children debt free in the event the doctor’s predictions came to fruition.

I now own my home free and clear.

Over the years the HOA has placed false information on my account, added illegal fines and were blatantly negligent in so many ways. Fines were made up or exaggerated, like an oil stain in the driveway that I cleaned up, yet later found out it was the "common area" and their responsibility to maintain.

There were so many things that the HOA did illegally, immorally, improperly and unethically that violated their own CC&Rs! (Conditions, Covenants and Restrictions)

They continually ignored my attempts to resolve these in any way. These included numerous registered letters, emails and phone calls. Several IDR (Internal Dispute Resolution) requests were also ignored. Not only were they ignored, but the CC&R’s clearly state the HOA MUST comply with these IDR requests.

I have since found out this is common practice of the HOA; they bombard you with paperwork and file motions to pad their legal fees and take advantage. I have an extremely dishonest and incompetent HOA who have made a career of going after homeowners for bogus fines.

The few incorrect fines they had added to my account initially totaled $1,300. I wasn’t worried as I didn’t owe this and had the documentation to back it up.

Much to my surprise, with their attorney’s fees, this $1,300 in wrongful fines has now climbed to over $32,000!

I did have a brief glimmer of hope at the beginning of the year when I was told that by filing bankruptcy, this would protect my home (even though I had no debt whatsoever and had perfect credit).

In the 15 years I have lived here, I have never been late with our monthly association dues. I keep impeccable records of every receipt, letter, conversation, and even pictures of all the damages they have caused.

There is so much more to this, but all the minor details would make this short story a novel.

When I began this process, I suppose I was a bit naïve. I believed that once the truth was revealed that justice would be served.

Now I may lose my home over an original dispute of $1,300 of incorrect fines.

I want to believe there is still a lot of good people out there willing to help and fight for what is right!

Unless I can come up with the $32,150 by Wednesday, September 25th, the sheriff' dept. will auction off my home.
