On December 8, 2007, American Portable Mini Storage, Inc. delivered Unit No. 118 to my residence. Between that date and December 15, 2007 family and friends assisted me in moving my possessions into the storage unit and on December 15, 2007 the unit was picked up.  During the pick-up of the unit the driver sold me a lock for the unit and assured me that I had the only keys.

In late 2008, I returned to the Columbia area to retrieve my belongings from American Portable Mini Storage.  My son and I met Dalton Davin at Americans storage site in Jessup, MD to retrieve my belongings. At the time Mr. Davin stated he did not have a list of customers and their respective units and my son and he would have to look for the storage unit by unit with the similar lock that was sold to me by their driver.  When they could not find any locked unit that fit the key, Mr. Davin used a tool to pick the locks of each storage unit, but upon opening and reviewing the contents of many storage units they concluded that the items that they had picked up from me and for which they received payment to store, were no longer in the possession of American Storage. Mr. Devin stated that certain of my possessions had been thrown away, without any explanation or any accounting of the items.

On March 01, 2010 the District Court of Maryland for Howard County entered a judgment in favor of me for this event.

It is my contention that for the security of your belongings that you place your belongings with other than American Portable Mini-Storage.

Lets address your rebuttal piece by piece to make sure we get the truth out on the table.  Lets start with your reputation.

  On November 1, 2001, an Order of Permanent Injunction And Other Relief was entered against Davlin by the United States District Court for the Western District of North Carolina in the case of Securities and Exchange Commission v. James A. Nies, Jeffrey Dene Leader and Harold Dalton Davlin, Civil Action No. 3:00-CV-465-MU (W.D.N.C.), permanently enjoining him from aiding and abetting violations of Section 10(b) of the Exchange Act and Rule 10b-5 promulgated thereunder. The Order of Permanent Injunction and Other Relief directed Davlin to pay disgorgement in the amount $17,072 plus prejudgment interest thereon, but waived prejudgment interest and did not impose a civil penalty, based upon Davlin's demonstrated inability to pay in excess of $17,072. Davlin consented to the entry of the Order of Permanent Injunction without admitting or denying the allegations contained in the Commission's complaint.

Moving right along here, your statement Mr. Longsworth is the only client who has sued me; he was 82 Since I was born in 1932, that would make me currently 80, again you lied. That statement begs me to ask the question if you thought it was okay to take my belongings because of my age.  Also, in regards to I am the only one who sued you, no sir the United Stated SEC sued you.

Go to the following site and scroll past my statement, guess this client must me of advanced age also.  This is of great interest to me because billing for my unit was automatic on my credit card, you stopped taking the payment in May and then my belongings disappeared.

Do a www.marylandjudiciary.com search on American Portable Mini Storage for MARYLAND / Dalton Davlin & u will find numerous cases listed. Cases going to court are normal for a storage company -- EXCEPT the fact that many of these cases are ruled "DISMISSED." Why is that? Why are they dismissed if renters owe money on their past-due units -- enough to take them to court? Why would the owner of AMERICAN PORTABLE MINI-STORAGE IN COLUMBIA MARYLAND, Dalton Davlin not show up for so many trials which is why cases are dismissed & ruled in favor of the defendent NOT the plaintiff?

Answer: American Portable Mini Storage run by Dalton Davlin in Columbia Maryland is a shady operation. Mr. Davlin is engaged in auctioning and/or selling off contents of portable storage units when renters are in arrears BEFORE proper process is followed. Since he gets his money this way behind the scenes, AND tries to get the customer to pay the arrears AT THE SAME TIME HE SELLS YOUR STUFF TO A THRIFT STORE or other such entity -- then theres no need for him to show up at court to collect further monies. So he doesnt show up. Repeatedly. He is terribly disorganized & never produces the proper receipts or paperwork needed for court trials. He doesnt show up with a lawyer either. Highly odd that so many trials involving his company are dismissed by the judge in FAVOR of the defendant!

Be highly suspicious of his other company COCARD Credit Card Processing Company located in Columbia, Md. on Red Branch Road. This man is a scheister from the word "go" and he will find semi-legit ways & opportunities to prey upon people who fall behind in payments on their units. He thinks he's very intelligent. Yeah - in the typical "criminal-intelligent" way. Avoid him & all his businesses like the plague. He is toxic & preys upon the down & out.

Now in regards to this statement He was only awarded  1/3rd of his request by the courts which was within a few hundred dollars of what I offered him.  Case closed.    Once again anyone wanting copies of this documentation I will be more than happy to scan and up load it to verify what I am stating is the truth.

1.            I was awarded $2024.00 your letter of 9/3/2009 (with check #3850, that you dated for      9/3/2002 is in the amount of $400.00) is a bit different than a few hundred dollars and if you are truly wanting to resolve this, why did you move your bank account when the court went to collect my settlement?  All this is a matter of record so think it over before responding as I have documentation that I will be more than happy to upload for the world to see.

2.            When you called the house to try and get out of paying the full amount, you offered $600.00


Your last paragraph is just plain amusing By reporting my other business names and citing a closed clase that was settled in 2002, Mr. Longsworth is clearly taking his experience out of context and implying that my practices, businesses and charactor are suspect.  I have owned multiple businesses in my name for more than thirty years and am happy to provide positive references from all my clients.  Thank you for discarding his report and seeing the truth. 

Sir, posting the SEC case is to confirm a pattern of bad business practices that spans over a decade. Like the saying goes, leopards dont change their spots.  You say youre an honest business man, then I will be expecting a check for the full amount of the settlement $2024.00 by the end of the week to show that you have changed your behavior indication in the SEC case.

As the  owner of American Portable Storage, my customers, friends, colleagues and family were disheartened to read this report when it showed up on my search engine; Mr. Longsworthy's account about me, my reputation and my business practices are untrue and without merit.  There are small grains of truth within his report but they are presented in a manner that prevents anyone to see me and my business for what it is.  Let me share with you some facts that have been excluded. 

Truth:  I own American Portable Storage, a small company located in Columbia Maryland and rent storage units for short and long term clients.  I have more than 120 units and have grown my business since 2006 and have over 1,000 clients. Mr. Longsworth is the only client who has sued me; he was 82 years old and was storing belongings for himself and 5 of his children; there was no confirmed written inventory ever supplied to me and no proof of a lock purchased.  However, I admitted that the container came back to the yeard without a lock on it; thus my team presumed it to be garbage.  He claimed it was filled; we claimed it was not.  There was significant mutual confusion as to the belongings stored and when I apololgized and offered a settlement for the inconvenience, Mr. Longsworth sued me.  He was only awarded  1/3rd of his request by the courts which was within a few hundred dollars of what I offered him.  Case closed. 

For anyone who needs short or long term storage, please feel free to call me and I will provide a list of my thousand plus clients who are more than satisfied with my services and would be happy to share their positive experiences with you.
