NOTICE OF SERVICE OF ORDER TO SHOW CAUSE BY THE SUPREME COURT OF THE STATE OF NEW YORK, COUNTY OF KINGS In the Supreme Court of the State of New York, County of Kings Alan Kneller and American Portfolio Asset Management, Inc., Plaintiffs v. John Does, 1-10, Defendants, Index No. 12497-12. To Unknown Defendants using the following screen names on the website ripoffreport.com: Tina-Brooklyn United States of America, Mary, SCAM, Mildred, Rebecca, and Joseph (together, “Defendants”): Take notice that Plaintiffs have moved, by Order to Show Cause, for a default judgment against Defendants for their claims for defamation and defamation per se arising from false and defamatory statements that Defendants published about them on the website www.ripoffreport.com. Plaintiffs seek an Order granting default judgment and permanently restraining Defendants from any further acts of defamation or publishing false statements, comments, or other information regarding Plaintiffs; mandating that Defendants take all action including, but not limited to, requesting www.ripoffreport.com, and Internet search engines such as Google, Yahoo!, and Bing, to remove all defamatory, disparaging, libelous, and false statements about Plaintiffs that Defendants posted on the above-named website; and declaratory judgment that Defendants’ comments posted on the website www.ripoffreport.com regarding plaintiffs are false.
By the December 11, 2013 Order of the Hon. Richard Velasquez, J.S.C., it is ordered that you or your attorneys show cause before the Supreme Court of the State of New York, County of Kings, at IAS Part #66 at the Courthouse located at 360 Adams Street, Brooklyn, New York, Courtroom #469, on the 11th of December, 2013, at 9:30, why an Order should not be granted, pursuant to CPLR § 3215, entering default judgment against you in the above-referenced matter and granting the above-listed relief.
