When we refinanced with City Mortgage, 2 months later it sold to America's Servicing Company. Now my payment has srisen by 300.00 because my escrow account was in the negitive. They double paid my insurance...Now because I I have a much higher payment I have been paying late (25th) Not even 30 days past due and I feel like they are harrassing me. They start calling on the 4th or 5th and continue to call. If we don't answer the call (not home) they have a terrible recording and leave a message about why they are calling. If I do get to talk to someone they are rude.

Most recently they sent a certified letterasking about our finances, and if they could help. Suposedly I am delinquent 1 payment (due on the 1st, last on the 16th, being paid on the 25 for 3 months now).

What are my rights, does anyone know? It is frustrating, we have asked that they change our due date, but they won't and they will not accept particial payments.

When we refinanced it was to get "away" from Wells Fargo and all of their BS.

They don't even offer to take payment on-line and do not have a real web site. They are behind in the times. Maybe they are ripping people off to cushion their profits to upgrade the web site...

I just read your comments on Americas Servicing Corp. And I'm sorry they are bugging you. The only way you can get away from them is to refiance again. But every mortgage company wants to be paid on the same days and you will be late on the same days. If you go past those lates days they will call and try to collect from you. Even if you haven't gone past 30 days. So you will never get away from the collectors phone calls no matter where you go. From what it sounds like your kind of getting over your head in mortgage payments. You might want to consider refiancing to get a lower payment and you can hopefully help two problems and breath a little easier. Sorry, hope this helps.
