Actually, the warrant for your arrest was issued because YOU didn't show up for court, not because your lawyer didn't show up. If he had shown up, and you had not, a warrant likely still would have been issued. I'm not trying to excuse what you allege, because you certainly do state a pretty serious lack of care on his part. I just wanted to clear up that point. To whom did you direct your request to see your "evidence file"? If you are referring to your attorney, yes he is obligated to let you view whatever he has in your file. In fact, it's considered your property. If you are referring to the court or the prosecutor, that's a different story. Although discovery is generally automatic and mandatory in criminal cases, your personal access to evidence may be hindered once an attorney enters an appearance on your part. Sounds like you need a new lawyer. And if you feel strongly about your allegations, I would certainly take the matter up with the state bar. Best regards!
