Jim - I wish you were right in your Nov 5th,2007 posting. I think the problem with your statement is you have not followed the facts of my case. I DID have my case docketed in the Supreme Court of the United States. - M.L. vs Astoria Federal. The exact words in the notice by the Supreme Court of the United States states: The Petition for a Writ of Mandamus in the above entitled case was filed xxxxxxxx and placed on the docket xxxxxxxxx as No. xx-xxxx. Also, Removal of a case from a State Court to a Federal Court is done by District Court of the United States. State Court MUST stop whatever they are doing, unless and until the case is remanded back to State Court. The issue is: the United States Federal Court had jurisdiction of M.L. vs Astoria Federal for ten months. In the fifth month of this ten month time frame - Astoria Federal and their corrupt attorneys continued on with their scam in State Court and auctioned off my two NYC condos. --Anything done is a Court without jurisdiction is a Void Judgment is one which from its' inception is and forever continues to be absolutely null. As I said before I have documented proof of all I claim. In addition, the Court has told me to come back but I have to find the right people to go back with since Astoria Federal is a very CORRUPT and powerful bank. Jim, I appreciate the time you have spendt posting. This RIP-OFF is a wonderful site. It far surpasses the hundreds of letters I write warning people of Astoira Federal and their CEO George L Engelke's corruption and racketeering.

What you're asking the Court to do is something they no longer do; Mandamus, for all practical purposes (I've confirmed this) doesn't happen at a Supreme Court level any longer (though theoretically it can happen - for practical purposes it just doesn't) - your writ is handled at Appellate Level under the Federal Court system. Now if that's where your writ is filed, fine. If the Appelate Court didn't grant you Mandamus, you might be out of luck. There would be no way the Supreme Court of any state, let alone NY, would allow the fraudulent selling of your property without sufficient cause either. The court would bend over backwards in your situation if you had sufficient evidence to provide the court - big powerful bank or not.

Every citizen of the United States with a federal question has a right unbroken to a Trial by Jury., given to us by the Seventh Amendment. When a case is removed to Federal Court that is the time you must pay and demand a Trial by Jury. That is exactly what I did. I paid the court and demanded a Trial by Jury. The first Federal Judge after reading the facts of the case stipulated in writing that Astoria Federal make a settlement with me. As usual each judge would rule for me, and when the Bank came in the back door my rights went out the window.That is how I ended up going to the US Supreme Court with a Writ of Mandamus, demanding that a lower Court give me a Trial by Jury. Marilyn - on what basis are you appealing your case to the Supreme Court and on what amendment to the constitution is your lawyer indicating was violated by the bank? Are you sure they'll even take the case - I sort of thought their calendar was already full for this year? I wonder if there are even 4 justices that would hear the case at this point????
